Resolution No. PC~2001-55 Page 3 EXHIBIT "B.2" PLANNING COMMISSION CUP-39 CONDITIONS OF APPROVAL The use of the private park shall conform substantially with the statements of operation, Exhibit "A", dated "Received September 14, 2001; October 9, 2001; October 15, 2001; and October 17, 2001" on file with the Planning Department, except as modified by the following conditions. Minor changes to the statements may be allowed subject to the approval of the Planning Director if found to be in substantial conformance to the approved exhibits. 2. Approval of this application shall be contingent upon City Council approval of PUD-87-22-1M. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this conditional use permit may be referred to the Planning Commission for subsequent review at a public hearing. If necessary, the Commission may modify or add conditions of approval to mitigate such impacts, or may revoke said conditional use permit. 4. The park shall be maintained in a neat and litter free manner at all times. 5. The approved hours of park use are as follows: Tuesday through Thursday: Friday: Saturday: Sunday: Monday: 3 PM to 10 PM 3 PM to 11 PM 8 AM to 11 PM 9:30 AM to 4 PM Closed Should neighbors use the park when a church function is not being held, the church shall be responsible to enforce all of the restrictions applicable to the use of the park except that no more than 50 individuals may use the park at any one time and all use of the park must cease by 9 PM. The use of the park area shall be limited to passive recreational uses only (including, but not limited to, picnics and wedding receptions). No organized competitive events shall take place in the park. The consumption of alcohol and the use of noise amplification are prohibited. 8. All activities in the park must adhere to the noise standards in the General Plan and in Chapter 9.04 of the Pleasanton Municipal Code. {end}
