Resolution No. PC~2001-55 <br />Page 3 <br /> <br /> EXHIBIT "B.2" <br /> PLANNING COMMISSION <br /> CUP-39 <br />CONDITIONS OF APPROVAL <br /> <br />The use of the private park shall conform substantially with the statements of <br />operation, Exhibit "A", dated "Received September 14, 2001; October 9, 2001; <br />October 15, 2001; and October 17, 2001" on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the statements <br />may be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />2. Approval of this application shall be contingent upon City Council approval of <br /> PUD-87-22-1M. <br /> <br />If operation of this use results in conflicts pertaining to parking, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this conditional use <br />permit may be referred to the Planning Commission for subsequent review at a <br />public hearing. If necessary, the Commission may modify or add conditions of <br />approval to mitigate such impacts, or may revoke said conditional use permit. <br /> <br />4. The park shall be maintained in a neat and litter free manner at all times. <br /> <br />5. The approved hours of park use are as follows: <br /> <br />Tuesday through Thursday: <br />Friday: <br />Saturday: <br />Sunday: <br />Monday: <br /> <br />3 PM to 10 PM <br />3 PM to 11 PM <br />8 AM to 11 PM <br />9:30 AM to 4 PM <br />Closed <br /> <br />Should neighbors use the park when a church function is not being held, the <br />church shall be responsible to enforce all of the restrictions applicable to the use <br />of the park except that no more than 50 individuals may use the park at any one <br />time and all use of the park must cease by 9 PM. <br /> <br />The use of the park area shall be limited to passive recreational uses only <br />(including, but not limited to, picnics and wedding receptions). No organized <br />competitive events shall take place in the park. The consumption of alcohol and <br />the use of noise amplification are prohibited. <br /> <br />8. All activities in the park must adhere to the noise standards in the General Plan <br /> and in Chapter 9.04 of the Pleasanton Municipal Code. <br /> <br />{end} <br /> <br /> <br />
