Resolution No. PC-2001-55 <br />Page 2 <br /> <br />The proposed conditional use will comply with each of the applicable <br />provisions of this chapter of the Municipal Code. <br /> <br />As proposed, the zoning of the site would allow the permitted and <br />conditionally permitted uses of the Public and Institutional (P) district, and the <br />P district conditionally permits parks. The proposed use complies with all <br />relevant sections of the zoning ordinance. Granting a conditional use permit to <br />the applicants for a park is consistent with the City's ability to regulate zoning <br />as listed in the Municipal Code Chapter 18.124 "Conditional Uses." <br /> <br />WHEREAS, <br /> <br />the Planning Commission determined that the proposed site improvements <br />and uses for the private park keeps the site compatible with the surrounding <br />uses. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-39, the application of the Church of Jesus Christ of <br />Latter Day Saints for a conditional use permit to change the land use of <br />approximately 1.97 acres of vacant land behind an existing church from six <br />single-family residential lots to a private park for church-related events <br />located at 3574 Vineyard Avenue, subject to the conditions shown in Exhibit <br />"B.2" attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />THIS RESOLUTION ADOPTED BY THE PLANNING COMMISSION OF THE CITY <br />OF PLEASANTON ON THE 28TH DAY OF NOVEMBER 2001 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Arkin, Maas, Roberts, and Sullivan <br />None <br />Commissioners Harvey and Kameny <br />None <br /> <br />Peggy l~zi~o <br />City Clerk <br /> <br />Trish Maas <br />Chairperson <br /> <br />APPRQVED ~AS, ,T9 FORM: <br /> <br />Larissa Seto <br />Assistant City Attorney <br /> <br /> <br />
