Resolution No. PC-01-40 <br />Page 6 <br /> <br /> approved landscape plan plus any conditions of approval, and shall be detailed in <br /> terms of species, location, size, quantities, and spacing. <br /> <br />13. <br /> <br />All trees used in landscaping shall be a minimum of 15 gallons in size and all <br />shrubs a minimum of 5 gallons, unless otherwise shown on the approved <br />landscape plan, or unless required as a condition of approval. <br /> <br />14. <br /> <br />Prior to issuance of a building permit, the site plan shall be modified to clearly <br />indicate the trees scheduled for removal and the trees to be preserved on the site. <br />These modifications shall be subject to review and approval by the Planning <br />Director. <br /> <br />15. <br /> <br />No trees shall be removed other than those specifically designated for removal on <br />the approved plans or in the tree report, unless otherwise approved by the <br />Planning Director. The applicant shall post cash, letter of credit, or other security <br />satisfactory to the Planning Director in the amount of $5,000 for each heritage <br />Valley Oak tree required to be preserved (Tree #295 and Tree #299). This cash <br />bond or security shall be retained for one year following acceptance of public <br />improvements or completion of construction, whichever is later, and shall be <br />forfeited if the trees are destroyed or substantially damaged. <br /> <br />16. <br /> <br />Every effort shall be made to preserve Tree #296 located along the retaining wall <br />at the front of the property; if it cannot be saved the amount of the value of the <br />tree shall be placed in the Urban Forestry Fund. <br /> <br />17. <br /> <br />Prior to issuance of a building permit, a temporary chain link fence or equivalent <br />construction fence shall be installed around the base of Trees #297 and #299 as <br />shown on the Tree Survey Map prepared by HortScience and around the three oak <br />trees located immediately east of the western property line on the Kottinger Drive <br />frontage in McKinley Park. This fencing shall be as far from the tree stem (trunk) <br />as possible, completely surrounding the tree, and 6-8 feet in height. Fencing shall <br />remain in place until completion of construction; removal of such fencing prior to <br />that time may result in a "stop work" order issued by the City. <br /> <br />18. <br /> <br />Once the retaining wall has been replaced on the north side of the development, a <br />protective chain link fence shall be placed around Trees #295 and #296 at a <br />minimum distance of 10 feet from the tree trunk. <br /> <br />19. <br /> <br />The following tree preservation methods shall be followed during construction on <br />the site. These methods shall be listed on the building permit plans and shall <br />include, but not be limited to, the following: <br /> <br />a. No grading and/or trenching or stockpiling of fill material may occur in <br /> the dripline of existing Valley Oak trees scheduled for preservation. <br /> <br />b. No equipment shall be operated or stored within the dripline of any tree. <br /> <br /> <br />
