Resolution No. PC-2001-37 <br />Page 3 <br /> <br />Exhibit "B", Final Conditions of Approval <br />PCUP-34, Gymboree Play and Music <br /> Oak Hills Shopping Center <br /> (5460 Sunol Boulevard, Suite 9) <br /> <br />The design, construction, and operation of the use covered by this approval shall <br />be substantially as shown on the narrative and development plans, Exhibit "A", <br />dated "Received June 14, 2001" on file with the Planning Department, except as <br />modified by the following conditions. Minor changes may be allowed subject to <br />the approval of the Planning Director if found to be in substantial conformance to <br />the approved exhibits. <br /> <br />The project developer shall pay any and all fees to which the property may be <br />subject prior to issuance of building permits. The type and amount of the fees <br />shall be those in effect at the time the building permit is issued. <br /> <br />This conditional use permit approval will lapse within one (1) year from the date <br />of approval unless a building permit is issued and construction has commenced <br />and is diligently pursued toward completion or an extension has been approved by <br />the City. <br /> <br />The building permit plan check materials will be accepted for submittal only after <br />completion of the fifteen- (15) day appeal period, measured from the date of the <br />approval letter, unless the project developer submits a signed statement <br />acknowledging that the plan check fees may be forfeited in the event that the <br />approval is overturned on appeal, or that the design is significantly changed as a <br />result of the appeal. In no case will a building permit be issued prior to the <br />expiration of the fifteen (15) day time-period. <br /> <br />At no time shall balloons, banners, pennants, or other attention-getting devices be <br />utilized on the site except as allowed by Section 18.96.060K of the Zoning <br />Ordinance for grand openings or by Section 18.116.040 of the Zoning Ordinance <br />if approved by temporary conditional use permit as part of a decorating plan in <br />conjunction with shopping center promotional events. At no time shall spot <br />lighting be used in conjunction with grand openings and/or promotional evems. <br /> <br />If operation of this use results in conflicts pertaining to parking, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this conditional use <br />permit may be referred to the Planning Commission for subsequent review at a <br />public hearing. If necessary, the Commission may modify or add conditions of <br />approval to mitigate such impacts, or may revoke said conditional use permit. <br /> <br />7. The business operator shall be required to keep the rear doors closed, but <br /> unlocked, during business hours. <br /> <br /> <br />
