PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2001-33 <br /> <br />A RESOLUTION ACCEPTING THE REVISED WORDING FOR <br />MITIGATION MEASURES 8.3.2, 5.3.12, AND 5.13.16 IN THE FINAL <br />SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT PREPARED FOR <br />OAK TREE FARM - PHASE III (PUD-97-01) <br /> <br />WHEREAS, <br /> <br />Currin Construction Company has submitted an application to certify the <br />final supplemental environmental impact report (FSEIR) for the Oak Tree <br />Farm - Phase 3 development plan (PUD-97-01); and <br /> <br />WHEREAS, <br /> <br />the Planning Commission held a noticed public hearing on June 13, 2001, <br />at which time it considered the completeness and adequacy of the Final <br />Supplemental EIR and recommended certification of the FSEIR, with <br />modifications to three mitigation measures; and <br /> <br />WHEREAS, <br /> <br />at its meeting of June 27, 2001, the Planning Commission reviewed staff's <br />recommended language for the three mitigation measures and accepted the <br />revised language. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Accepts the following wording for mitigation measures 8.3.2, 5.3.12, and <br />5.3.16 included in the final supplemental environmental impact report <br />(FSEIR) for the Oak Tree Farm - Phase 3 development plan (PUD-97-01): <br /> <br />8.3.2 <br /> <br />Mitigation Measure: Any proposed development of previously- <br />undeveloped or unimproved land in portions of the Oak Tree Farm <br />property shall require the preparation of a current biological <br />assessment by a consulting biologist for the property proposed for <br />development. This biological assessment shall include a database <br />and literature review of all potential sensitive species, an on-site <br />field reconnaissance of the project site, and resultant species- <br />specific recommendations and surveys. The results of this <br />assessment and any recorrzrnendations by the consulting biologist <br />shall be submitted to the U.S. Fish and Wildlife Service and all <br />other agencies determined to have jurisdiction for their review and <br />determination as to whether permits are necessary prior to the <br />approval of the PUD development plan. Additionally, the City <br />shall have the assessment peer reviewed by a consulting biologist. <br />The developer shall be responsible for reimbursing the City for the <br />cost of all peer review services it deems necessary for the review <br /> <br /> <br />
