Exhibit "B", Final Conditions of Approval for <br />Vesting Tentative Subdivision Map 7240 <br /> <br />April 28, 2001 <br /> <br />The final subdivision map and improvement plans shall substantially conform the vesting <br />tentative subdivision map, Exhibit "A", dated "Received April 20, 2001" on file with the <br />Planning Department, except as modified by the following conditions. Minor changes to <br />the plans may be allowed subject to the approval of the Planning Director if found to be <br />in substantial conformance to the approved exhibits. <br /> <br />This vesting tentative map shall only become effective if this project receives growth <br />management program approval by the City Council within one (1) year of the Planning <br />Commission's approval of the vesting map. This approval shall lapse if the project de- <br />veloper fails to record a final map prior to expiration of the growth management ap- <br />proval. <br /> <br />This vesting tentative map shall incorporate by reference all conditions and requirements <br />of PUD-00-01, the approved PUD Development Plan covering this subdivision, as ap- <br />proved by the City Council. <br /> <br />The project developer shall record CC&R's at the time of recordation of the first final <br />subdivision map, which shall create a property owners association for the development. <br />Parcel "A" shall be excluded from the association. The CC&R's shall be subject to the <br />review and approval of the City Attorney prior to recordation of the final map. The prop- <br />erty owners association shall be responsible for the following: <br /> <br />a. Maintenance of the open space areas of Parcels "C" and "D". <br /> <br />Maintenance of the screen planting located between the property lines of Lots 4, 5, <br />11, 12, 17, 18, 29, 31, 32, and 36, and the trail to be located on the old Vineyard <br />Avenue right-of-way. <br /> <br />Maintenance of the frontage planting facing new Vineyard Avenue along Lots 27, <br />30, 32, and Parcel "B". <br /> <br />d. Maintenance of the area between Parcel "A" and new Vineyard Avenue. <br /> <br />Maintenance of the existing walnut tree to be located in the landscape circle located <br />in "Darcie Place". <br /> <br />Exhibit "B", Vesting Tentative Map 7240 Page 1 of 9 <br />Per Planning Commission Approval April 28, 2001 <br /> <br /> <br />
