Plans for and design of the modifications to the south residence wall shall be submitted in conjunction with the building permit application and be subject to review and approval by the Planning Director prior to the issuance of building permits. All site improvements and construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through Saturday. No construction shall be allowed on Federal Holidays. All construction equipment shall meet DMV noise standards and be equipped with muffling devices. Prior to the issuance of a building permit, the applicant shall pay all fees associated with this project. The type and amount of the fees shall be those in effect at the time of building permit issuance. Plan check materials will be accepted only after the completion of the fifteen (15) day design review appeal period (calculated from the approval letter date), unless the applicant submits a signed statement acknowledging that the plan check fees may be forfeited in the event that the approval is overturned or the design is significantly changed as a result of the appeal. In no case will the building permit be issued prior to the expiration of the appeal period. The applicant shall be responsible for purchasing a twenty-four inch (24") box size, evergreen-type tree, if desired by the appellants, to be planted in the appellants' side yard facing the window covered by this approval. The installation of the tree shall be the responsibility of the appellants.
