42.

With recordation of the first final map covering Lots 1 through 29, 31 through 32, and
Parcel "B", the project developer shall pay to the City of Pleasanton fees for City distri-
bution to the South Livermore Valley Agricultural Land Trust. The fees would be calcu-
lated based on a one-to-one (1:1) ratio between the cost per acre for agricultural ease-
ments to the Land Trust and the net acreage of potentially cultivable soils located on
lands having less than a twenty-five percent (25%) slope grade.

Building and Site Design Requirements:

43. The house on Lot 33 shall be single-story.

44.

Lot 31 shall be deleted. This change shall be shown on the tentative subdivision map
submitted to the Planning Commission for review and approval.

45. Lot 30 shall be developed with a single-story house.

46.

The project developer shall provide automatic opening sectional roll-up garage doors
throughout the project, as approved by the Director of Building Inspection and Planning
Director.

47.

The project developer and the Planning staffshall explore the redesign of Lots 33 through
36 by: a) reducing the area devoted to Lot 33 and redistributing this area to Lots 34, 35,
and 36; and, b) reorienting the homes on Lots 34, 35, and 36 such that the large private
yard areas are provided that are protected from the noise of the RMC/Lonestar plant by
the homes located on these lots. The redesign for this area of the development shall be
submitted to the Planning Commission for review and approval with the tentative subdi-
vision map.

48.

The project developer shall implement the "green building measures" listed under the
"Green Building Measures for The Hahner Project" with the design and construction of
all of the homes covered by this approval. The project developer may modify these
measures, e.g., add new measures, or change existing measures if there are other, more
effective measures, which can feasibly be done. Additionally, the project developer shall
work with City staff to prepare a summary report of the effectiveness of implementing
the selected components, including as feasible, the costs and benefits of each component.
This report shall be prepared following construction of seventy-five percent (75%) of the
project units, with actual energy use data from occupied units, if possible, which shall be
forwarded to the Planning Commission for its review.

49.

Private yard lighting shall be designed, installed, and controlled so as not to be pointed
directly towards the existing and future "uphill" properties located along the south side of
Old Vineyard Road.

Page- 13-
