Resolution No. PC-01-02 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case PUD-04 <br />6088 Sunol Boulevard <br /> <br />PLANNING <br /> <br />Development shall be substantially as shown on the development plans and <br />colorboard, Exhibit "A", dated "Received January 11, 2001" on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br /> <br />The applicants shall obtain all building and other applicable City permits for the <br />project prior to the commencement of construction. <br /> <br />The developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. The type and amount of the fees shall be <br />those in effect at the time the building permit is issued. <br /> <br />This PUD development plan approval shall lapse and shall become void 2 years <br />from the date of approval unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion or an extension has been <br />approved by the City. <br /> <br />5. Medical and dental uses shall be prohibited uses on the subject property. <br /> <br />Prior to issuance of a building permit, the applicants shall reimburse the North <br />Sycamore Specific Plan funding developer(s) for its pro rata share of the North <br />Sycamore Specific Plan capital improvements as stipulated by the North <br />Sycamore Specific Plan Finance Plan. <br /> <br />Prior to occupancy, the applicants shall join the North Sycamore Specific Plan <br />Maintenance Association as determined by the City Engineer. The site's <br />maintenance association fees shall be based on the site's pro rata share in a <br />manner consistent with the North Sycamore Specific Plan Finance Plan. <br /> <br />Parking lot sweeping, deliveries, shipping/receiving, landscaping, leaf blowing, <br />and similar commemial or maintenance activities shall be limited to 8:00 am to <br />7:00 pm, Monday through Friday. <br /> <br />At no time shall balloons, banners, pennants, or other attention-getting devices be <br />utilized on the site except as allowed by Section 18.96.060K of the Zoning <br />Ordinance for grand openings or by Section 18.116.040 of the Zoning Ordinance <br />if approved by temporary conditional use permit as part of a decorating plan in <br />conjunction with shopping center promotional events. At no time shall spot light- <br />ing be used in conjunction with such grand openings and/or promotional events. <br /> <br /> <br />
