Resolution No. 02-024 <br />Page Two <br /> <br />Section 4: <br />Section 5: <br /> <br />That in all particulars not recited in this resolution, the election shall be held and <br />conducted as provided by law for holding municipal annexation elections. <br /> <br />That said Special Election shall be conducted by all mail ballot, and shall be <br />conducted pursuant to Chapter 2 of Division 4 (Commencing with Section 4100) <br />of the California Elections Code only insofar as required by law, and only where <br />not inconsistent with the other state law regarding annexations. Notwithstanding <br />Elections Code SeCtion 4103, ballots cast in this Special Election shall be returned <br />to the office of the City Clerk no later than 5:00 p.m. on election day. Only ballots <br />received in the office of the City Clerk by 5:00 p.m. on election day shall be <br />counted. <br /> <br />Section 6: <br /> <br />That the City Clerk is authorized and directed to set dates for direct arguments and <br />rebuttals. <br /> <br />Section 7: <br /> <br />That notice of the time and place of holding the election is given and the City <br />Clerk is authorized, instructed and directed to give further or additional notice of <br />the election, in time, form and manner as required by law. <br /> <br />Section 8: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON FEBRUARY 19, 2002 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Councilmembers - Ayala, Campbell, Dennis, Michelotti, and Mayor Pico <br /> <br />Michael H.
