PURCHASE AGREEMENT <br /> <br /> This Purchase Agreement ("Agreement") is made the day of __ <br />City of Pleasanton ("City") and Philip Ciesielski ("Purchaser"). <br /> <br />., 2002 between the <br /> <br />RECITALS <br /> <br />A. The City owns an unimproved parcel of land ("the Property"), approximately 14,000 square <br />feet in size and located in the 4100 block of Stanley Boulevard, about 600 feet east of Main <br />Street; the Property has no street access, is landlocked, and is bound by private single <br />family residences to the north and east, by private property along the Arroyo Del Valle to <br />the south, and by the Pleasanton Mobile Home Park to the west. <br /> <br />B. Using gas tax funds, the City acquired the Property for $9,103 in 1968 from John A. <br />Comer, Ethel L. Comer, Herman Edster and Margaret Edster. <br /> <br />C. After the Comers/Edsters sold the City the Property, they sold land to the north of the <br />Property (4160 Stanley) to Chris Beratlis in 1968, who in turn sold it to Jessie Boerner in 1969; <br />Ms. Boerner sold 4160 Stanley to Purchaser in 1994. <br /> <br />D. The City purchased the Property in 1968 because the City, at that time, had plans to <br />extend Del Valle Parkway from Main Street to Stanley Boulevard; in 1996, the City <br />Council decided that this extension was not warranted and removed the proposed <br />extension from the General Plan. <br /> <br />E. Pubic records do not disclose that the ownership of the Property includes rights of access <br />to or from any public street; the City has gained access to the Property for weed abatement by <br />going through the property at 4128 Stanley Boulevard. <br /> <br />F. The Property in the General Plan is designated Medium Density Residential; the zoning for <br />the Property is R-1-20-00 (Single-Family Residential). <br /> <br />G. The property at 4160 Stanley Boulevard, owned by Purchaser, which is to the north of the <br />Property, is zoned R-1-20,000; a single family residence and an accessory structure are located on <br />it. <br /> <br />H. The Property is not useful to the City for street purposes, public park and recreational <br />purposes or any other public purpose. <br /> <br />I. Because of constant weed abatement, the Property requires continued maintenance not to <br />be an annoyance to the neighbors. <br /> <br /> <br />
