WHEREAS, Chris Beratlis applied for a conditional use permit to <br />operate a 940 sq. ft. "take -out" restaurant at <br />929 "B" Main Street; and <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br />PLANNING COMMISSION <br />CITY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br />RESOLUTION NO. 2325 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF PLEASANTON APPROVING A USE PERMIT FOR <br />CHRIS BERATLIS AS FILED UNDER CASE UP -83 -16 <br />zoning for the property is C -C (Central Commercial) <br />District; and <br />this application is exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />at their duly noticed public hearing of July 13, 1983 <br />the Planning Commission considered all public testimony, <br />exhibits and recommendations of City Staff; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use is in accord with the objectives <br />of this chapter and the purposes of the district in which <br />the site is located; and <br />WHEREAS, the Planning Commission found that the proposed location <br />of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental <br />to the public health, safety, or welfare or be materially <br />injurious to properties or improvements in the vicinity; and <br />WHEREAS, that the proposed conditional use will comply with each <br />of the applicable provisions of the Ordinance Code. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES THE FOLLOWING: <br />Section 1. Approves case UP -83 -16 as filed by Chris Beratlis <br />subject to the following conditions: <br />1. That this use permit is granted for the 940 sq. ft. <br />building known as 940 -B Main Street only. <br />2. That this use permit shall be reviewed by the <br />Planning Commission within one year. <br />3. That the operator of the restaurant shall use his <br />best efforts to insure that his customers do not <br />consume food sold on the premises immediately outside <br />of the building and that customers do not loiter in <br />front of or around the place of business. <br />
