DRAFT <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. <br />AN ORDINANCE RELATING TO SECONDARY DWELLING UNITS <br />FOR RENTAL PURPOSES ON SINGLE FAMILY LOTS ADDING <br />ARTICLE 6.5 (SECONDARY DWELLING UNITS FOR RENTAL <br />PURPOSES) TO AND AMENDING CERTAIN OTHER RELEVANT <br />PROVISIONS OF CHAPTER 2 (ZONING), TITLE II (ZONING <br />AND DEVELOPMENT) OF THE ORDINANCE CODE OF THE <br />CITY OF PLEASANTON. <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />Section 1. Article 6,5 (Secondary Dwellings for Rental Purposes) <br />is added to Chapter 2 (Zoning), Title II (Zoning and <br />Development) of the Ordinance Code of the City of <br />Pleasanton to read. as follows: <br />Article 6.5 <br />Secondary Dwelling Units for Rental Purposes <br />2- 6.33.01 Purposes and Definitions. In order t <br />provide for expanded housing opportunity and to <br />implement the provisions of State law, this article <br />allows for the addition of a secondary dwelling <br />unit for rental purposes on any lot zoned R -1, R -M <br />or PUD- Residential already containing a single <br />family residence. A secondary dwelling unit is a <br />dwelling attached and subordinate to a primary <br />residence. <br />2- 6.33.02 Conditional Use Permit Required. A <br />conditional use permit shall be required in order to <br />add a secondary dwelling unit for rental purposes on <br />a residential lot, The issuance of the conditional <br />use permit shall be in accord with the provisions of <br />Article 25 of this chapter. In the RM zoning district <br />an applicant may have the option of applying for approval <br />of a secondary dwelling unit for rental purposes under <br />the provisions of Article 6 of this chapter. <br />2- 6.33.03 Owner Occupancy of Primary Residence Required. <br />The conditional use permit required by Section 2- 6.33.02 <br />shall be issued only to the owner occupant of the existing <br />single family residence on the lot. Said permit shall <br />automatically lapse when the applicant ceases to be the <br />owner- occupant of the primary residence. A new owner <br />occupant may apply for a new and separate use permit <br />to continue or re- establish the use of the secondary <br />dwelling unit for rental purposes. <br />
