because we have an industrial business park, a PUD that allows trade schools but over time the <br />City has broadened what has been allowed. He questioned whether these types of uses are <br />incompatible and should be in another location, but he understands that it is cheaper to rent a <br />space here rather than downtown which might be more appropriate. The topic is similar to struggles <br />the Council and Planning Commission have with licensed day care facility issues. Therefore, he is <br />supportive of Option 3 which allows the business to operate as originally approved but does not <br />allow the expansion. <br /> <br />Vice Mayor Cook-Kallio said she did not get the impression that the Council was choosing between <br />one business or another. She was supportive of both and did not feel they were mutually exclusive <br />and can both co-exist and there has been precedence set in the industrial park. <br /> <br />Councilmember McGovern said what worries her is that there is only so much industrial zoning in <br />the community. She asked staff to return with information on the amount and location of industrial <br />zoning because she believed it might be taken over by many CUP’s. To be a thriving city, the City <br />should have industrial lands to promote those businesses. She would support Option 3 and <br />probably would have supported limiting the number of students to 3 at a time because during the <br />summer starting at 10AM, it will be an impact on businesses to have 5 students there. <br /> <br />SUBSTITUTE MOTION: Councilmember Sullivan made a Substitute Motion for Option 3 to allow <br />the business to remain as it currently is conditioned under its existing permit. Councilmember <br />McGovern seconded the motion. Motion failed by the following vote: <br /> <br />Ayes: Councilmembers McGovern, Sullivan <br />Noes: Councilmembers Cook-Kallio, Thorne, Mayor Hosterman <br />Absent: None <br /> <br />Resolution No. 09-280 <br />ORIGINAL MOTION: It was m/s by Thorne/Hosterman to adopt denying <br />the appeal and supporting the Planning Commission’s recommendations to the City Council with <br />amendment to Condition 10; patrons of the studio are required to wait in the waiting room; and for <br />staff to clarify whether the CC&R’s restrict the use of on-street parking; with an amendment not to <br />limit instruction and allow up to 5 instructors at any one time.
