Ordinance No. 1443 <br /> <br />Section 3: Section 18.116.050 of Chapter 18.116 of Title 18, of <br /> the Pleasanton Municipal Code as follows: <br /> <br /> 18,116.050 Christmas Tree Sales in R-1 and RM <br /> Districts. <br /> <br /> Christmas tree sales lots may be approved by the Zoning <br /> Administrator provided that the findings required by <br /> Section 18,124.070 shall be made. The procedures and <br /> requirements for Christmas tree sales lots in R-1 and RM <br /> Districts shall be as set forth below. <br /> <br /> A. Procedure <br /> <br /> 1. Notice of the proposed Christmas tree sales <br /> lot shall be sent by mail to all property <br /> owners shown on the last equalized assessment <br /> roll as owning real property within 300 feet <br /> of the exterior boundaries of the site of the <br /> proposed sales lot at least 10 days prior to <br /> the date on which the decision will be made on <br /> the use permit application. <br /> <br /> 2. If a hearing is requested, the zoning <br /> administrator shall schedule a public hearing <br /> to be held prior to a decision being made. No <br /> public hearing shall be held unless such a <br /> request is made. <br /> <br /> B. Requirements <br /> <br /> 1. The minimum setback between the Christmas tree <br /> sales lot and any existing residential use <br /> shall be 100 feet. <br /> <br /> 2. No permit shall be granted unless the <br /> operation of the outdoor sale will not be <br /> detrimental to the public health, safety and <br /> general welfare. Conditions may include, but <br /> shall not be limited to: <br /> <br /> a. review of site plan to assess lighting <br /> and traffic circulation so as not to <br /> interfere with surrounding residential <br /> uses. <br /> <br /> b. requiring the organization to obtain a <br /> City business license. <br /> <br /> c. limitation of hours of operation. <br /> <br /> Page 2 <br /> <br /> <br />
