<br />bridge across the Arroyo de la Laguna, as approved herein. <br />Should the developer be unable to acquire said land, the City <br />may use its power of eminent domain. The applicant shall <br />reimburse the City for any cost incurred in the land <br />acquisition. No more than 60 dwelling units in Land Unit B <br />shall be allowed to be occupied until the new bridge is <br />completed and open for use. However, if the City Traffic <br />Engineer feels that traffic safety in the vicinity of the <br />intersection of Bernal Avenue and the Unit B entry is being <br />compromised at any time during the project buildout, measures <br />shall be taken to the satisfaction of the city Engineer to <br />address the safety problems. <br /> <br />9. The developer may enter into a reimbursement agreement with <br />the City to recover the costs associated with the acquisition <br />of property to the south (San Francisco Water District) <br />relative to the construction of the bridge. <br /> <br />10. That the final map exhibit shall reflect the addition of a <br />short segment of sidewalk linking the interior street <br />sidewalk with the Bernal/Foothill intersection through the <br />wrought iron fence, and the extension of the sidewalk along <br />the Bernal Avenue frontage of Unit B easterly to the I-680 <br />underpass. The developer shall be responsible for installing <br />these improvements in conjunction with the related street <br />improvements at the first phase of development on the site. <br /> <br />11. That the applicant shall install the bridge and street <br />improvements along Bernal Avenue in conformance with the <br />conditions of the master POD approval. The applicant's pro- <br />rata share shall be considered to be the improvements <br />depicted in "Alternative D: Interim Alignment", on file with <br />the Planning Department. These improvements shall be <br />depicted, in addition to the "Alternative D: Ultimate <br />Alignment" improvements, on the final map for the project. <br /> <br />12. That the developer shall work with the City toward mutual <br />agreement on a design for a traffic light standard for the <br />Bernal/Foothill intersection which achieves the required <br />lighting and traffic control function, yet retains the rural, <br />"old-style- ambiance de. ired for the area to the maximum <br />extent possible. <br /> <br />13. That, except as modified above, all conditions of the <br />original master POD approval (PUD-89-5i Ordinance No. 1408) <br />shall remain in full torce and effect. <br /> <br />14. That this development is subject to all of the "Standard <br />Conditions of Development-, attached hereto and made part of <br />this case by reference, except Conditions No.7, 9, 14, 16, <br />25, 29, 31, 50, and 55. <br />
