CONDITIONS OF APPROVAL <br /> PUD-90-05 <br /> <br /> EXHIBIT <br /> <br /> 1. That the project shall substantially conform to the <br /> development plan, dated March 9, 1990 on file with the <br /> Planning Department, except as modified herein. <br /> <br /> 2. That uses and development standards of Parcel 1 shall be <br /> those of the R-i-40,000 District. <br /> <br />3. That no further development of either Parcel 1 or Parcel <br /> 2 shall occur without prior City approval. <br /> <br /> 4. That the developer shall apply for and receive City <br /> approval for subdivision of the property prior to the <br /> sale of either Parcel 1 or Parcel 2; said subdivision <br /> shall be subject to recordation of the annexation of <br /> this property to the City. <br /> <br /> 5. That the applicant shall dedicate to the city for street <br /> right-of-way purposes, the applicant's rights to Trenery <br /> Drive, presumed to be 1/2 of the 60 foot Trenery Drive <br /> right-of-way. This dedication shall take the form of an <br /> "Open Offer of Dedication" on the parcel map and as quit <br /> claim deed by separate instrument, unless otherwise <br /> approved by the City Engineer. <br /> <br />6. The applicant shall enter into a deferred street <br /> improvement agreement for street improvements across the <br /> project's Trenery Drive frontage which are not installed <br /> with the project's initial development. Street <br /> improvements shall be based on a future street <br /> configuration of a private street, 20 feet from edge of <br /> pavement to edge of pavement, with 8 feet wide rolled <br /> shoulders (including drainage); street improvements may <br /> include joint trench and/or electroliers. <br /> <br />7. The applicant shall pay a pro rata cost of the <br /> installation of a stormdrain to serve Trenery Drive at <br /> such time that a storm drainage system is installed. <br /> This requirement shall be included in the deferred <br /> improvement agreement described in Condition No. 6. <br /> <br /> Page 3 <br /> <br /> <br />
