5. It is hereby found, determined and ordered that <br /> <br /> MacKAY & SOMPS, CI~ILi~ENGINEERS, INC., shall be Engineer of Work in <br /> accordance with the terms and conditions of the petitions hereinabove <br /> referred to, and contract to be hereinafter entered into between <br /> said MacKAY & SOMPS and the City of Pleasanton. It is hereby further <br /> agreed that STURGIS, DEN-DULK, DOUGLASS & ANDERSON, Attorneys at <br /> Law, shall be Special Bond Counsel to prepare all proceedings in <br /> accordance with the terms and conditions of the petitions hereinabove <br /> referred to, and contract to be hereafter entered into between said <br /> STURGIS, DENLDULK, DOUGLASS & ANDERSON and the City of Pleasanton. <br /> <br /> 6. That the public interest and convenience will be <br /> <br /> served by the taking of special assessment proceedings for the <br /> construction and acquisitions set forth in said petitions. The cost <br /> and expenses thereof shall be borne by a district benefited by said <br /> improvements. Said district shall be known and designated as <br /> "Assessment District No. 64-3, Arroyo Del Valle Interceptor Sewer <br /> <br /> Project, City of Pleasanton, County of Alameda, State of California". <br /> 7. The district which shall bear the cost and expenses <br /> <br /> Of said improvements and acquisitions, including all incidental <br /> expenses, and which is to be assessed to pay for the cost of said <br /> improvements and acquisitions, is that district shown on a map which <br /> is on file in the office of the City Clerk of the City of Pleasanton, <br /> which is designated, "Map Showing Boundaries of District Proposed to <br /> be Assessed for Construction of Improvements in Assessment District <br /> <br /> No. 64-3, Arroyo Del Valle.Interceptor Sewer Project, City of Pleasanton, <br />· County of Alameda, State of California." <br /> <br /> 8. That in view of the fact that 87.6% of the owners <br /> <br /> of the property within the area to be assessed for the cost of said <br /> improvements have petitioned for said improvements, this City <br /> <br /> Council hereby finds that the public interest and convenience require <br /> that this City Council undertake proc&edings for the construction <br /> of improvemen~s~ add ~quisition ~f p~oBertyunder, the p'roVisions of th~ <br /> Municipal Improvement Act of 1913 and the Improvement Ac~ of 1911, <br /> and without further compliance with the provisions of the Special <br /> Assessment Investigation, Limitation and Majority Protest Act of <br /> <br /> 1931 of the State of California, now found in Division 4 of the Streets <br /> and Highways Code. <br /> <br />-2- <br /> <br /> <br />
