RESOLUTION NO. .3582 <br /> <br />RESOLUTION OF PRELIFfINARY DETERMINATION TO UNDER- <br />TAKE SPECIAL ASSESSMENT PROCEEDI~GSZFOR THE CON- <br />STRUCTION OF IMPROVEMENTS AND ACQUISITION OF <br />PROPERTY IN ASSESSMENT DISTRICT NO. 64-3, ARROYO <br />DEL VALLE INTERCEPTOR SEWER PROJECT, CITY OF <br />PLEASANTON, ALAMEDA COUNTY, CALIFORNIA. <br /> <br /> BE IT RESOLVED by the City Council of the City of Pleasanton, <br />County of Alameda, State of California, as follows: <br /> <br /> 1. The petitions of property owners for the improvements <br /> <br />to be constructed by special assessment proceedings of the property <br />within the boundaries of the map designated "Map Showing Boundaries <br />of District Proposed to be Assessed for Construction of Improvements <br />in Assessment District No. 64-3, Arroyo Del Valle Interceptor Sewer <br />Project, City of Pleasanton, County of Alameda, State of California", <br />which said map is on file in the office of the City Clerk of the City <br />of Pleasanton, are incorporated herein by this reference as though <br />fully set forth herein. <br /> 2. The certificate of MacKAY & SOMPS, CIVIL ENGINEERS, INC., <br />dated September 14, 1964, certifying that the petition hereinabove <br />referred to was signed by the owners of 87.6% of the area of the property <br />described in said petitions, that said property owners have waived <br />all proceedings under the Special Assessment Investigation, Limitation <br />and Majority Protest Act of 1931, and have requested special assess- <br />ment proceedings for the improvements described in said petitions, <br />is incorporated herein by this reference as though fully set forth <br />herein. <br /> 5. it is hereby ordered and determined that the terms and <br /> conditions of said petitions heretofore incorporated herein be, and <br /> they are hereby, accepted and the improvements shall be constructed <br /> and property acquired in accordance with the terms of said petitions, <br /> and that the assessment district proceedings shall be instituted and <br /> carried through in accordance with the terms of said petitions. <br /> 4. It is hereby found, determined and ordered that the <br /> terms and conditions of the petitions heretofore incorporated herein <br /> be, and they are hereby, accepted and the improvements shall be <br /> constructed in accordance with the terms of said petitions, and that <br /> the assessment district proceedings shall be instituted and <br /> carried through in accordance with the terms of s~id petitions, <br /> <br />COPY <br /> <br /> <br />
