31. Prior to each phase of the project after the first <br /> phase being reviewed by the Design Review board, the <br /> applicant shall prepare a traffic study, satisfactory <br /> to the City Engineer, using the City's standard <br /> assumptions for a short-term traffic study and covering <br /> the Mozart PUD affected intersections- In the event <br /> that "existing plus approved plus project" traffic <br /> conditions would create a LOS E condition, the <br /> applicant shall utilize mitigation measures to lower <br /> the service level to LOS D (v/c ration of 0.90 or <br /> lower) or building permits shall be withheld for that <br /> project phase. Should the only available mitigations <br /> be not feasible for the applicant to implement on its <br /> own, the applicant shall assume a leadership role in <br /> requesting the formation of an appropriate assessment <br /> district or other mechanism to provide the required <br /> mitigation improvements. The City shall cooperate in <br /> the formation of such districts or other mechanisms so <br /> that benefitted properties would pay their fair share <br /> of the improvements. <br /> <br />32.
