Exhibit A <br /> Conditions of Approval <br /> PUD-81-22-6M <br /> <br />A. PUD Modifications. PUD-81-22, as amended, is modified as <br /> follows: <br /> <br /> 1. The master plan for the PUD is hereby modified to show <br /> the 27.8 acre Wells Fargo Bank site as containing five, <br /> five-story buildings containing approximately 604,750 <br /> sq. ft. of gross floor area, generally configurated as <br /> shown on the site plan dated "14 May 90." The site may <br /> include a detached day care facility generally as shown <br /> on the alternate site plan dated "14 May 90" so long as <br /> the total floor area of all buildings is not increased. <br /> <br /> 2. Condition 56 requiring certain levels of traffic <br /> mitigation is hereby modified with respect to the Wells <br /> Fargo Bank project by waiving the requirement that <br /> mitigation measures achieve mid-LOS D~ the requirement <br /> shall be that mitigation measures achieve LOS D. <br /> <br /> 3. The developer shall participate in th~ provision of <br /> parks and recreation facilities in a manner to be <br /> determined by the City following a study of the <br /> reasonable parks and recreation needs of employees of <br /> north Pleasanton business parks. Participation by the <br /> developer shall be equal to the pro rata share of the <br /> capital cost of acquiring and developing the parks and <br /> recreation facilities determined to be necessary as a <br /> result of the impact of the commercial/office uses in <br /> PUD-81-22. The manner of the participation, whether <br /> through development fees, assessment districts or some <br /> other manner, shall be determined upon City review of <br /> the aforementioned study, and shall take into <br /> consideration parks and recreation needs at present and <br /> in the future by phasing necessary improvements as <br /> appropriate. The developer shall cooperate with the <br /> City in providing the parks and recreation facilities by <br /> making this obligation run with the land on all land <br /> owned and/or controlled by Mozart/Wells [argo. The City <br /> agrees to use its best efforts to assess all north <br /> Pleasanton business park developers and employers on a <br /> pro rata basis for the parks and recreation facilities <br /> made necessary by north Pleasanton development, and the <br /> City shall explore methods to accomplish this as part of <br /> the aforementioned study. <br /> <br /> 4. Except as modified by Conditions A-l, A-2 and A-3 above, <br /> all conditions of PUD-81-22, as amended, shall remain in <br /> full force and effect. <br /> <br /> -1- <br /> <br /> <br />
