CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1490 AN ORDINANCE APPROVING CASE PUD-9~-7, THE APPLICATION OF JAYAND KYOUNGKUFOR PLANNED UNIT DEVELOPMENT ZONINGAND DEVELOPMENT PLAN APPROVAL FOR A SENIOR CARE FACILITY WHEREAS, Jay and Kyoung Ku have applied for Planned Unit Development rezoning and development plan approval to construct a two-story, approximately 48,000 sq. ft., 70 room senior care facility to be located on an approximately 1.5 acre site located on the north side of Mohr Avenue immediately westerly of the former Southern Pacific Railroad right-of-way; and WHEREAS, zoning for the property is "O" (Office) District; and WHEREAS, a duly noticed public hearing was held on November 20, 1990 at which time all public testimony and relevant exhibits were considered; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on November 20, 1990; and WHEREAS, Council received the Planning Commission's recommendations' for approval of the proposed zoning change and development plan; and WHEREAS, a resolution was adopted by Council on November 20, 1990 approving maximum permissible sewer discharge; and WHEREAS, the City Council finds that the proposed rezoning and development plan are consistent with the PUD considerations of the Zoning Ordinance, and General Plan policies of the City of Pleasanton; and WHEREAS, the Council finds that the project is not subject to growth management fees, lower income housing fees, park dedication fees, bedroom tax, or other residential fees. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAINS AS FOLLOWS: Section 1. Approves the rezoning of an approximately 1.5 acre site located on the north side of Mohr Avenue immediately westerly of the former Southern Pacific Railroad right- of-way to the PUD (Planned Unit Development) - Commercial/Offices District.
