CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1490 <br /> <br /> AN ORDINANCE APPROVING CASE PUD-9~-7, THE APPLICATION OF <br /> JAYAND KYOUNGKUFOR PLANNED UNIT DEVELOPMENT ZONINGAND <br /> DEVELOPMENT PLAN APPROVAL FOR A SENIOR CARE FACILITY <br /> <br />WHEREAS, Jay and Kyoung Ku have applied for Planned Unit <br /> Development rezoning and development plan approval to <br /> construct a two-story, approximately 48,000 sq. ft., 70 <br /> room senior care facility to be located on an <br /> approximately 1.5 acre site located on the north side of <br /> Mohr Avenue immediately westerly of the former Southern <br /> Pacific Railroad right-of-way; and <br /> <br />WHEREAS, zoning for the property is "O" (Office) District; and <br /> <br />WHEREAS, a duly noticed public hearing was held on November 20, <br /> 1990 at which time all public testimony and relevant <br /> exhibits were considered; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on November 20, 1990; <br /> and <br /> <br /> WHEREAS, Council received the Planning Commission's <br /> recommendations' for approval of the proposed zoning <br /> change and development plan; and <br /> <br /> WHEREAS, a resolution was adopted by Council on November 20, 1990 <br /> approving maximum permissible sewer discharge; and <br /> <br /> WHEREAS, the City Council finds that the proposed rezoning and <br /> development plan are consistent with the PUD <br /> considerations of the Zoning Ordinance, and General Plan <br /> policies of the City of Pleasanton; and <br /> <br /> WHEREAS, the Council finds that the project is not subject to <br /> growth management fees, lower income housing fees, park <br /> dedication fees, bedroom tax, or other residential fees. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAINS AS <br /> FOLLOWS: <br /> <br /> Section 1. Approves the rezoning of an approximately 1.5 acre site <br /> located on the north side of Mohr Avenue immediately <br /> westerly of the former Southern Pacific Railroad right- <br /> of-way to the PUD (Planned Unit Development) - <br /> Commercial/Offices District. <br /> <br /> <br />
