south wall of the shopping center and the project wall on <br /> the shopping center property. <br /> <br /> 7. That, if feasible, the project wall shall include a gate in <br /> the vicinity of Unit 10 to provide access between the <br /> residential development and the adjacent Vintage Hills <br /> shopping center. The gate shall be designed to be <br /> controlled through a card or key system to provide security <br /> for the residents. The design of the gate and security <br /> system shall be submitted for review and approval by the <br /> Planning Director prior to the issuance of building permits <br /> for the project. <br /> <br /> 8. That the developer shall ensure that four of the 24 units <br /> within the project shall be sold to the owner-occupant home <br /> buyers whose incomes do not exceed the "moderate-income" <br /> level, i.e., no more than 120% of the most recent median <br /> income level for the Alameda and Contra Costa county areas <br /> (Oakland PMSA) and at a sales price which is considered <br /> affordable to a moderate income, four-person household (based <br /> on HUD criteria). The goal of the moderate income program <br /> shall be to provide these four units at the lowest possible <br /> price to maximize affordability for moderate income <br /> households. Toward that end, the City agrees to waive all <br /> City fees for the four moderate income townhouse units <br /> described above. The details of the moderate income program <br /> shall be prepared by the applicant and submitted for review <br /> and approval by the Planning Commission in conjunction with <br /> the tentative map. <br /> <br />9. That the low walls surrounding the front patios of Units 1 <br /> through 5 shall be raised to a sufficient height so that <br /> automobiles traveling on Bernal Avenue will not be visible <br /> to persons seated on the patios (approximately 4 feet high <br /> as measured from the inside of the patio). The final design <br /> of the walls shall be submitted for review and approval by <br /> the Planning Director prior to recordation of the final map. <br /> <br />10. That the proposed driveways on Palomino Drive shall be <br /> changed from the street-type opening to a standard driveway <br /> curb cut. The final design shall be subject to review and <br /> approval by the City Engineer prior to recordation of the <br /> final map for the project. <br /> <br />11. That the proposed sanitary sewer shall tie into the public <br /> sanitary sewer line on Palomino Drive. <br /> <br />12. That, if adequate capacity exists, all on-site storm drains <br /> shall tie into the catch basin on Palomino Drive and the <br /> proposed storm drain ~o Bernal Avenue shall be eliminated. <br /> <br /> <br />
