All land located between the masonry wall on Del Valle Parkway <br /> and the masonry wall/wrought iron fence on Stanley Boulevard <br /> and street curb shall be dedicated to the City as public <br /> right-of-way. <br /> <br />50. The applicant shall be responsible for undergrounding all of <br /> the existing overhead P.T. & T. and P.G. & E. utility lines <br /> located along the Del Valle Parkway and Stanley Boulevard side <br /> of the property in conjunction with tract improvements. The <br /> final utility plan shall be submitted with the tentative map <br /> for review by the Planning Commission. The applicant shall be <br /> eligible for reimbursement of one-half of the undergrounding <br /> costs along his project frontage as properties on the other <br /> side of the road develop. <br /> <br />51. The applicant shall maintain a minimum 2' separation between <br /> the wrought iron fence along Alley "Two" and the underground <br /> pipeline belonging to the Santa Fe Pacific Pipeline Co. The <br /> applicant may reduce the 4' landscape area along alley "two" <br /> to 2' to accommodate this fence/pipeline separation as allowed <br /> by the Director of Planning. A 10' easement area, <br /> satisfactory to the Santa Fe Pacific Pipeline Company, shall <br /> be shown on the tentative map. Landscaping within this area <br /> shall be limited to turf, groundcover, and/or low growing <br /> shrubs and shall be shown on the final landscape plan prior to <br /> issuance of building permits. <br /> <br />52. The perimeter masonry fence located along the townhouse front <br /> yards shall be no taller than 5', referenced from the <br /> townhouse property's front yard grade. <br /> <br />53. The applicant shall enter into an agreement with the City to <br /> enable the City to enforce eight townhouse and eight single- <br /> family detached moderate income ownership units and 46 low- <br /> income rental units. This agreement shall be approved prior <br /> to approval of the final map. <br /> <br />54. The applicant shall implement the standard conditions of <br /> development except nos. 5, 6, 7, 21, 22, 23, 25, 29, 31, 46, <br /> and 50. Standard Condition No. 24 is modified to waive low <br /> income development fees for all 158 units and to waive all <br /> City development fees for the 16 moderate income units and the <br /> 46 low income units. <br /> <br /> <br />
