6. Prior to the filing of a Final Map on the subject property, CC&Rs for entire development shall <br /> be approved by the City Attorney; these CC&R's shall provide for a homeowners association <br /> with sufficient power to manage all commonly owned and/or maintained areas. The City shall <br /> be named as third party beneficiary of said CC&Rs and shall be granted the power to enforce <br /> its provisions if the property owners association fails to do so. The owners association shall <br /> pay for all costs incurred by the City in the enforcement of the CC&Rs. <br /> <br />7. Development standards for accessory structures within the townhome development shall be <br /> submitted to the Planning Director for review and approval prior to the issuance of any final <br /> map.. The design review process for accessory structures and any subsequent building <br /> additions, for the entire development, shall be based on .the Ple,_~nton Municipal Code. <br /> <br />8. Exterior walls shall be flee of air conditioning, heating or other mechanical equipment. <br /> <br />9. Final inspection is required by the Planning Department prior to occupancy. <br /> <br /> 10. Any backflow prevention devices (double check values) installed with the development shall be <br /> painted forest green (Pantone color system number 2030) and shall be screened with <br /> shrubbery. The shrubbery shall be of a species and planted at a density to satisfactorily screen <br /> the device and shall be designed to blend with adjacent landscaping. All such devices shall be <br /> shown on the plans submitted for issuance of building permits. The adequacy of such <br /> screening shall be determined by the Planning Department prior to issuance of building <br /> <br /> 11. During the processing of the tentative map for the townhome units, changes to the site plan, <br /> roadway configuration, or guest parking spaces may be required based on subsequent review <br /> of the more detailed engineering plans. <br /> <br /> 12. The applicant shall submit a complete final development package for the townhome portion of <br /> the development for the review and approval of the Design Review Board prior to approval of <br /> the tentative map. <br /> <br /> 13. Prior to tentative map approval, all modifications and/or changes required by the Design <br /> Review Board, Planning Commission, and/or City Council to the Moller Ranch Design <br /> Standards shall be combined into a single comprehensive document. This document shall be <br /> submitted to the PIning Director for review and approval prior to publication. <br /> <br /> 14. Grading <br /> <br /> a. Split pad lots, including front-to-back and side-to-side, shall be used in the detached <br /> units when appropriate to blend the contours with the natural topography. These <br /> details shall be included in the tentative map application for review and approval by the <br /> Planning Commission. <br /> <br /> <br />
