EXHIBIT "B" <br /> CONDITIONS OF APPROVAL <br /> PUD 90-20, PEPPERTREE PARK <br /> <br />1. Development shall be substantially as shown on the development <br /> plans, Exhibit "A", dated "Received January 15, 1991" on file <br /> with the Planning Department, except as modified by these <br /> conditions. <br /> <br />2. Prior to occupancy, the landscape architect shall certify in <br /> writing, in a manner acceptable to the Planning Department, that <br /> the landscaping has been installed in accordance with the <br /> approved landscape plans with respect to size, number and species <br /> of plants, and overall design concept. <br /> <br /> 3. Prior to issuance of building permits, revised rear elevations of <br /> the B units which include fixed high windows on the second story <br /> shall be submitted to the Design Review Board for review and <br /> approval. <br /> <br />4. Prior to the issuance of building permits, architectural and site <br /> plans for the inclusion of 3 single-story detached units shall be <br /> submitted to the Design Review Board for review and approval. <br /> <br /> 5. A homeowners association shall be established for detached <br /> portion of the development. The CC&R's for the association shall <br /> incorporate the following conditions: <br /> <br /> a. Long term parking is prohibited in the driveways of the <br /> units. Except for overnight loading and unloading from <br /> trips and temporary daytime parking (less than 8 hours) <br /> residences shall not park vehicles within the driveway. No <br /> overnight parking is allowed. Boats and recreational <br /> vehicles shall not be parked within the subject development. <br /> <br /> b. That residents or guests of the detached units shall not <br /> park within the guest parking spaces of the townhome <br /> development. <br /> <br /> c. All trees located within the front yard areas shall be <br /> maintained in good health and vigor at all times. The <br /> homeowner's association shall be responsible for the care <br /> and maintenance of the landscape area within the front yard <br /> area and for the Rheem Drive frontage. <br /> <br /> d. The garage parking spaces shall not be used for long term <br /> storage, in excess of 72 hours, and shall be maintained <br /> unobstructed and available for parking of vehicles. <br /> <br />6. A homeowner's association shall be established for townhome <br /> portion of the development.
