EXHIBIT C <br /> <br /> PROPOSED CEQA FINDINGS <br /> FOR PUD-89-17/OAK ~ FARM <br /> <br />The Draft Supplemental Environmental Impact Report (Draft SvIR) has identified a number of <br />significant or potentially significant environmental impacts of the proposed 69-Iot development <br />plan for the 91 acre site located at 8015 Foothill Road. The City Council, as a decision-making <br />body, must maim written findings explaining how it has addressed each significant environmental <br />impact and each alternative identified in the Final Supplemental Environmental Impact Report <br />(Final SF-rP0. The Final Sgra consists of the Draft S~-m., response to comments and any <br />changes in the Draft. If the City Council adopts a mitigation measure different from one <br />recommended in the SEIR, the Council must find that the adopted measure will effect the same <br />reduction in impact as the recommended measure. <br /> <br />Lalld Use alld Phllaiag Impacts <br /> <br /> 1. Project exc__~ed_s average density and holding, capacity_ <br /> <br />IMPACT: The City Council finds that exceeding the average density of the site 's General <br />Plan land use designations and exceeding the holding capacity of the site as defined in the City' s <br />General Plan, is a significant impact, <br /> <br />DEGREE: Potentially Significant. <br /> <br />FINDING: The Council finds that certain situations and conditions of approval pertinent to <br />the proposed plan, presented as Exhibit A, am suffi~t to off-set the implementation of this <br />55-unit plan which exceeds the mid-point density (5I units) for this site. The Council finds as <br />follows: the proximity of the site to the ~u~t Bay Regional Park District's Ridgelands Regional <br />Park and the City's Augustine Bemal Park is sufficient in that these path provide open space <br />ridequate to off-set the implementation of a plan which results in 55 units; the inclusion, within <br />the open space area of the site, of l~{ldng trails available for use by the residents of the proposed <br />development, and ~ to the Ridgelands Regional Park provida adequate, on-site open space <br />amenity; and thc requLrcmcnt of a conservation casement to preserve the open space area in <br />perpetuity is a visual, open space amenity for the rest of the community. The Council finds that <br />these measures arc fcaxiblc and have been incorporated into the project design or into the project <br />by reference through conditions of approval, and will be cffcctive in reducing the impacts of this <br />project to a less than significant level. <br /> <br /> p~r~ C-1 <br /> <br /> <br />
