De1 Valle Parkway ("Little Stanley"): <br /> <br /> - all permanent improvements and lanes on the north <br /> side, from Rachel Place to Stanley Boulevard <br /> including sidewalk, curb and gutter and through <br /> lane <br /> <br /> - permanent island and median <br /> <br /> - interim improvements on south side consisting of <br /> through lane and on-street bike lane/shoulder (no <br /> curb, gutter, or sidewalk) <br /> <br /> - small right-of-way acquisition from Augusta <br /> property for sidewalk construction <br /> <br /> - lower grade crossing at old'S.P.R.R. <br /> <br /> The developer shall negotiate in good faith to acquire any <br /> necessaryright-of-way along Stanley Boulevard for the interim <br /> s~reet alignment. If the developer is unable to acquire said <br /> right-of-way, the City may use its power of eminent domain =o <br /> acquire said proper~y. The developer shall reimburse the City <br /> for all right-of-way costs incurred in the acquisition. <br /> <br /> 21. Across the sitems frontage, the developer shall pay for one- <br /> half of all of the ultimate right-of-way necessary to be taken <br /> from properties on ~31e south side. of Stanley Boulevard in <br /> order to equalize the contribution towards street improvements <br /> from each proper~y owner adjoining the street. The developer <br /> shall be responsible for improving one-half of the ultimate <br /> s~reet improvements (north side) either ~lrough installation <br /> of~the interim street improvements or' by payment of the <br /> estimated cos= of these improvements not installed. Interim <br /> improvements which will. be retained with the ultimate <br /> improvements will be credited against the costs of permanent <br /> improvements not installed. The developer may be eligible for <br /> reimbursement as other proper~ies develop for permanent <br /> improvements to the southerly side of the road beyond his <br /> normal obligation. <br /> <br />22. The applicant shall install two bus turnouts and enclosures on <br /> the north side of Stanley Boulevard. One bus stop shall be <br /> located on the east side of- the intersection of Stanley <br /> Boulevard and De1 Valle Parkway and the other shall be located <br /> on the west side of the intersection of California Avenue and <br /> Stanley Boulevard. The location and design of these bus stops <br /> shall be submitted for review and approval by the Planning <br /> Commission prior to the approval of the tentative map. <br /> <br />Page 5 <br /> <br /> <br />
