Ordinance No. 1568 Page 2 WHEREAS, the City Council finds that the modification to eliminate the condition limiting the hours of use and requiring gating for a portion of the parking area would be an inappropriate modification, but finds that the modification to eliminate the condition limiting the floor area utilized by high parking demand tenants to no more than 21,355 sq. ft. is consistent with the General Plan policies of the City of Pleasanton and with the intent of PUD 85-10. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Denies that portion of the application of Portfolio Property Investors for a major modification to the governing PUD-85-10 to eliminate the condition limiting the hours of use and requiring gating for a portion of the parking area at Hopyard Village Center, an existing shopping center located at 3003-3059 Hopyard Road and 5725-5737 Valley Avenue. Section 2: Approves that portion the application of Portfolio Property Investors for a major modification to the governing PUD-85-10 to eliminate the condition to limit the floor area utilized by high parking demand tenants at Hopyard Village Center, subject to the conditions on Exhibit "B" attached hereto and by this reference incorporated herein. Section 3: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of Pleasanton, and complete ordinance shall be posted for fifteen (15) days in the city Clerk's office within fifteen (15) days after its adoption. Section 4: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
