Ordinance No. 1568 <br />Page 2 <br /> <br />WHEREAS, the City Council finds that the modification to eliminate <br /> the condition limiting the hours of use and requiring <br /> gating for a portion of the parking area would be an <br /> inappropriate modification, but finds that the <br /> modification to eliminate the condition limiting the <br /> floor area utilized by high parking demand tenants to no <br /> more than 21,355 sq. ft. is consistent with the General <br /> Plan policies of the City of Pleasanton and with the <br /> intent of PUD 85-10. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Denies that portion of the application of Portfolio <br /> Property Investors for a major modification to the <br /> governing PUD-85-10 to eliminate the condition limiting <br /> the hours of use and requiring gating for a portion of <br /> the parking area at Hopyard Village Center, an existing <br /> shopping center located at 3003-3059 Hopyard Road and <br /> 5725-5737 Valley Avenue. <br /> <br />Section 2: Approves that portion the application of Portfolio <br /> Property Investors for a major modification to the <br /> governing PUD-85-10 to eliminate the condition to limit <br /> the floor area utilized by high parking demand tenants at <br /> Hopyard Village Center, subject to the conditions on <br /> Exhibit "B" attached hereto and by this reference <br /> incorporated herein. <br /> <br />Section 3: A summary of this ordinance shall be published once <br /> within fifteen (15) days after its adoption in "The <br /> Tri-Valley Herald," a newspaper of general circulation <br /> published in the City of Pleasanton, and complete <br /> ordinance shall be posted for fifteen (15) days in the <br /> city Clerk's office within fifteen (15) days after its <br /> adoption. <br /> <br />Section 4: This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br /> <br />
