CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1568 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> PORTFOLIO PROPERTY INVESTORS FOR A MAJOR <br /> MODIFICATION TO AN APPROVED PLANNED UNIT <br /> DEVELOPMENTAS FILED UNDER CASE pUD-85-10-1M <br /> <br />WHEREAS, portfolio Property Investors has applied for a major <br /> modification to an approved Planned Unit Development to <br /> delete two requirements: 1) limiting the floor area <br /> utilized by high parking demand tenants to no more than <br /> 21,335 sq. ft.; and 2) limiting the hours of use and <br /> requiring gating for a portion of the parking area at <br /> Hopyard Village Center, an existing shopping center <br /> located at 3003-3059 Hopyard Road and 5725-5757 Valley <br /> Avenue <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br /> - Commercial; and <br /> <br /> WHEREAS, the PUD for a day care facility, a commercial/office <br /> building, and additional parking area was approved in <br /> October, 1985; and <br /> <br /> WHEREAS, Council received the Planning Commission's recommendation <br /> 1) to deny the request to eliminate the parking control <br /> and time restrictions for the eastern parking lot area <br /> adjacent to La Petite Academy; 2) to add a requirement <br /> that the existing chain barrier separating the main <br /> parking area from the La Petite Academy parking area be <br /> replaced with a metal gate; and 3) to approve the <br /> elimination of 21,335 sq. ft. "cap", but require staff <br /> review on a curb by curb basis of high parking demand <br /> tenants through the zoning certificate process; and <br /> WHEREAS, a Negative Declaration was previously prepared and <br /> adopted for the project and the scope of the proposal <br /> falls within the scope of the previously adopted negative <br /> declaration; and <br /> <br /> WHEREAS, a duly noticed public hearing was held on July 7, 1992; <br /> and <br /> <br /> <br />
