SECTION 2 <br />FINDINGS REGARDING PROJECT ENVIRO IMPACTS <br />DETERMINED TO BE SIGNIFICANT IN EIR <br /> <br />Pursuant to CEQA Guidelines Section 15091, the Design Review Board and <br />Planning Commission have recommended adoption to the City Council <br />findings for each significant environmental impact of the project <br />identified in the FEIR as they relate to the project currently proposed. <br />The City Council has considered these recommendations and have adopted <br />them, with any applicable chages, heroin. <br /> <br />2.1 Land Use and Planning <br /> <br />Ownership and Management of CommOn Open Space <br /> <br /> Impactl Unresolved ownership and management of open space <br /> <br /> The City finds that approval of the project without resolution of <br /> details concerning ownership.and management of project ownership is <br /> a potential significant impact (Draft EIR, page 3-13). <br /> <br /> Proposed Mitigation Measure of the EIR: <br /> <br /> The EIR identified the following mitigation measure which can <br /> substantially avoid this impact. <br /> <br /> 3-1 Prepare and Adopt an Open Space Management Plan (Draft EIR, <br /> page 3-13). Said mitigation measure was considered and <br /> adopted with any pertinent changes as Condition 3-1, Exhibit <br /> "B" of the City Council staff report dated June 16, 1992. <br /> <br /> Finding: Mitigation Measure 3-1 Feasible and Required <br /> <br /> The City finds that it. is feasible to mitigate this impact to <br /> a less-than-significant level by requiring the applicant and <br /> successors in interest to prepare an open space ownership and <br /> management program to identify the on-going open space <br /> preservation and management mechanisms, responsibilities for <br /> improvements and actions. The City will adopt said program <br /> for purposes of implementation. The applicant and successors <br /> of interest shall incorporate the provisions of such adopted <br /> program into project design and implementation as a condition <br /> : of project approval. <br /> <br /> <br />
