EXHIBIT B <br /> <br /> Conditions of Approval <br /> Case PUD-91-13/Kottinger Hills <br /> (September 15, 1992) <br /> <br /> General <br /> <br /> 1. The proposed development shall be substantially as shown on <br /> the site plan, grading plan, project description, and <br /> related materials, "Exhibit A" (dated "Received October 11, <br /> 1991"), on file with the Planning Department, except as <br /> modified by these conditions. Minor changes to the approved <br /> plans may be allowed subject to the approval of the Planning <br /> Director if found to be in substantial conformance to the <br /> approved exhibits. <br /> <br /> 2. The developer shall apply for allocation of residential <br /> units under the City's Growth Management Program (GMP). <br /> Submittal of an application for tentative map, vesting <br /> tentative map, or any subdivision map approval for the <br /> residential portion of the project shall not be accepted <br /> until the project has received its GMP allocation. The golf <br /> course suites shall be subject to normal GMP requirements. <br /> <br />3. This project shall be subject to the Standard Conditions of <br /> Development, attached hereto and made part of this case by <br /> reference, except Conditions 7, 8, 14, 22, 23, 25, 37,.55, <br /> and 56. <br /> <br /> 4. The developer shall obtain all building and/or other <br /> applicable City permits for the project prior to the <br /> commencement of construction. <br /> <br />5. This development plan shall be of no further validity and <br /> the developer shall be required to submit the same or new <br /> development plan for City approval prior to development of <br /> the site in the event that any of the following occur: <br /> <br /> a. The developer fails to apply for growth management <br /> approval within 2% years of PUD approval, or <br /> <br /> b. Subsequent to such approval, the developer allows the <br /> growth management approval to lapse, or <br /> <br /> c. If exempt from growth management, the developer fails <br /> to record a final map within two years of PUD approval. <br /> <br /> 1 <br /> <br /> <br />
