6. The proposed Tentative Map for the project shall include the specific details of the <br /> proposed bus stop and shelter relocation. This detail shall be subject to review and <br /> approval by the Planning Director and City, Engineer prior to its inclusion in the proposed <br /> tentative map. <br /> <br />7. A homeowner's association shall be established for the subject property. The CC&R's for <br /> the association shall incorporate the following conditions: <br /> <br /> a. The 23 open parking spaces located throughout the development shall be reserved <br /> for guests. No overnight parking by occupants shall be allowed. <br /> <br /> b. The garage parking spaces shall not be used for long term storage, in excess of 72 <br /> hours, and shall be maintained unobstructed and available for parking of vehicles. <br /> <br /> c. The association shall be responsible for maintaining all common open space, <br /> private utilities, private streets, project walls, the Santa Rita soundwall, the Santa <br /> Rita Road landscaping, and other landscape areas and improvements within the <br /> development. The City shall be granted the rights and remedies of the <br /> association, but not the obligation, to enforce the maintenance obligations. The <br /> City Attorney shall review and approve the proposed CC&R's prior to the <br /> recordation of a final subdivision map for the project. <br /> <br /> 8. The homeowner's association for the project shall be responsible for the maintenance of <br /> the landscape area along the property's frontage, up to the back of sidewalk along Santa <br /> Rita Road. <br /> <br /> 9. Final design details for the soundwall and wrought iron fence including location, design, <br /> landscape berming, and materials shall be submitted for review and approval by the <br /> Planning Director prior to final map approval. The soundwall around the recreation area <br /> shall generally have a fifteen foot setback from the Santa Rita sidewalk. In addition, the <br /> section of soundwall east of the southem project identification sign shall be eliminated. <br /> <br /> 10. The final design details of the tot-lot and barbecue area shall be submitted to the Planning <br /> Director and Community Services Director for review and approval prior to any final <br /> map approval. The final design details shall include a low wrought-iron fence which <br /> secures the tot-lot and barbecue area from the private street to the east. <br /> <br /> 11. The sidewalk shown on the plans along the easterly side of the main driveway shall be <br /> eliminated. <br /> <br /> PUD-96-15 CONDITIONS OF APPROVAL Page 2 of 12 <br /> <br /> <br />
