any conditions of approval, and shall be detailed in terms of species, location, size, <br /> quantities, and spacing. The following items shall be incorporated on the plan: <br /> <br /> a) The landscape plan shall be modified to include podocarpus or similar tall <br /> shrub/small accent tree in the area between the employee lounge and the <br /> westernmost parking lot in order to help soften the appearance of the <br /> parapet screen wall around the equipment well. <br /> <br /> b) Landscape betms and clusters of shrubs shall be added to the 20 ft. wide <br /> setback area between the patio screenwall and the proposed Mohr Avenue <br /> sidewalk. These changes shall be submitted for the review and approval <br /> by the planning Director on the plans submitted for the issuance of a <br /> building permit. <br /> <br />7) The use of the patio areas for storage purposes or for the hanging of laundry shall be <br /> strictly prohibited. The operator shall advise all residents and diligently enforce this <br /> policy. <br /> <br />8) The developer shall negotiate in good faith to obtain approval from the County, Zone 7, <br /> and East Bay Regional Park District for installing and maintaining landscaping in a <br /> portion, approximately 3 0 feet in width, of the former Southern Pacific Railroad <br /> right-of-way along the project site's eastern property line prior to the occupancy of the <br /> facility. In the eventuality that permission is granted, the developer shall install <br /> landscaping, comprised of native trees, shrubs, and groundcover, subject to the review <br /> and approval by the Planning Director, and maintain and irrigate the landscaping at all <br /> times in an appropriate manner. If the permission is obtained for said landscaping, an <br /> open style fencing, subject to the review and approval by the Planning Director, shall be <br /> installed along the eastern property line instead of the 6 ft. high solid fencing shown on <br /> the plans. <br /> <br /> 9) The developer shall negotiate in good faith with the owner of the adjacent office <br /> building to obtain an agreement for overflow parking during the evenings and weekends <br /> in that parking lot in the event that the on-site spaces of the assisted living facility are <br /> filled. The developer shall also revise the off-site improvement plans to show on-street <br /> parking spaces along the north side of Mohr Avenue in front of the project. This <br /> agreement and the revised improvement plans showing on-street parking shall be <br /> submitted for the review and approval by the Planning Director prior to the issuance of a <br /> building permit. <br /> <br /> 10) The developer shall be responsible for the completion of street frontage improvements <br /> across the project frontage and the adjacent County-owned transportation corridor <br /> (former railroad right-of-way) to the east. In addition, the developer shall install a new <br /> concrete curb and gutter on the south side of Molar Avenue from Kolin Street to the <br /> eastern portion of the transportation corridor.
