C. The property described in the Deed of Agricultural Conservation Easement <br /> in favor of the City of Livermore, a California municipal corporation, and the County <br /> dated November 11, 1992 and recorded in the Official Records of Alameda County, <br /> August 12, 1993, as instrument no. 93-288483. The property is more particularly <br /> described in attached Exhibit "C" (Signature). <br /> <br /> 3. The properties listed in paragraph 2 of this Amendment are being annexed to the <br />City of Livermore and are the subject of a settlement agreement and recorded conservation <br />easements by and among Partners, County and the City of Livermore. In executing the <br />Development Agreement, the parties to the Development Agreement did not intend to in any way <br />amend, infringe, impair, limit, condition or otherwise adversely affect in any way the rights of <br />the paxties to the aforesaid setfiement agreement and conservation easements. <br /> <br /> 4. Execution and recordation of this Amendment shall confirm that the Development <br />Agreement at no time heretofore or hereafter shall in any way be construed to have been or to <br />be a lien, encumbrance, or restriction on or affecting any of the properties described hereinabove <br />or any part thereof or interest therein. <br /> <br /> 5.
