RECORDED AT THE REQUEST OF <br />AND WHEN RECORDED RETURN TO: <br /> <br />CITY OF PLEASANTON <br />Attention: Michael Roush <br />123 Main Street <br />Pleasanton, CA 94566 <br /> ABOVE SPACE FOR RECORDER'S USE <br /> <br /> AMENDMENTTO <br /> DEVELOPlV~NTAGREEMENT <br /> <br /> THIS AMENDMENT TO DEVELOPMENT AGREEMENT ("Amendment") is entered <br />into on this 21st day of September, 1993 by and between the COUNTY OF ALAMEDA <br />("County"), a public agency of the State of California; the CITY OF PLEASANTON, a general <br />law city in the State of California ("City"); and RUBY HILL DEVELOPMENT JOINT <br />VENTURE, L.P., a California limited pannet'ship ("Parmers"). <br /> <br /> 1. The above Paxties entered into a Development Agreement dated November 17, <br />1992 and recorded in the Official Records of Alameda County June 15, 1993 as instrument no. <br />93210619. <br /> <br /> 2. By this Amendment, the Parties intend to delete ab initio from the Development <br />Agreement the following properties. By way of further clarification, all references to the <br />"Subject Property" as defined in the Development Agreement shall be deemed not to include the <br />foregoing properties. <br /> <br /> A. The property described in the Deed of Agricultural Conservation Easement <br /> in favor of the City of Livermore, a California municipal corporation, and the County <br /> dated November 11, 1992 and recorded in the Official Records of Alameda County <br /> August 12, 1993 as instrument no. 93-288485. The property is more particularly <br /> described in attached Exhibit "A" (Kalthoff') <br /> <br /> B. The property described in the Deed of Agricultural Conservation Easement <br /> in favor of the City of Livermore, a California municipal corporation, and the County <br /> dated November 1 i, 1992 and recorded in the Official Records of Ala_meda County, <br /> August 12, 1993, as instrument no. 93-288488. The property is more particularly <br /> described in attached Exhibit "B" (Detjens). <br /> <br /> <br />
