932!CS!9 objeclive standards and regulations, shall be processed by the County or City in accordance with its established ordinances, regulations and policies generally applicable to property similarly situated to the Subject Property and shall be reviewed in accordance with the ordinances, regulations and policies in effect on the date of permit application; provided, however, that such ordinances, regulations and policies do not require denial of any application, or modification of the application or of the Project, where the aspect of the Project upon which the application is based, or which is the subject of the modification (including, but not limited to, matters such as location of buildings or uses), is in conformance with the terms of PD 1837 and PD 1949, as modified by Exhibits "B" , "E" and "F" hemto, or any subsequent approvals which have been incorporated in this Agreement. Only such discretionary permits and approvals as are permitted pursuant to subsection 2.3 shall be applicable to the Subject Property and Proje~:t. Such permits and approvals shall be evaluated in accordance with the standards specified in subsection 2.3 and 2.4. The County and City shall be entitled to exercise their discretion as provided by law and subject to the provisions of this Agreement, provided that the County or City shall not deny any application, or require any modification of an application or of the Project, where the aspect of the Project upon which the denial is based, or which is the subject of the modification (including, but not limited to matters such as location of buildings or uses), is in conformance with the terms of PD 1837 and PD 1949, as modified by Exhibits "B", "E" and "F" hereto, or any subsequent approvals which have been incorporated in this Agreement. 6. Construction of Off-Site Trdffic Improvements. The County, City and Partners agree that Partners' obligation to mitigate the traffic impacts of the Project with respect to either constructing or contributing to the cost of any off-site improvements are limited to those set forth in provisions 67 and 68 of Exhibit "D" to PD 1837 and Exhibits "B", "E" and "F". No other off-site improvements, or contributions to off-site improvements, shall be required of Partners at any phase of development of the Project. 7. CooDeration. in_!mDlementation. Upon satisfactory.. completion by Partners of all required preliminary actions as provided in PD 1837 and PD 1949, as modified by Exhibits "B" , "E" and "F" hereto, and payment of required processing fees, if any, the County and/or City shall proceed in a reasonably expeditious manner, and in compliance with deadlines mandated by any applicable agreements, statute or ordinance, to complete all steps necessary for the implementation of this Agreement and the development of the Project in accordance with PD 1837 and PD 1949, as modified by Exhibits "B", "E" and "F" hereto, including, without limitation, the following: (a) Scheduling any required public hearings or consideratioz{ by the Board of Supervisors or Planning Commission of Alameda County or the City Council or Planning Commission of the City of Pleasanton; and 3\11/93: rubyhtll.de'velapm_.~.qm 9
