14. As part of the disclosure statement for the development for those lots which are required <br /> to preserve existing trees, wording shall be included notifying all future home buyers of <br /> the requirement to preserve said trees. This wording shall be submitted to the Planning <br /> Director for review and approval prior to final map approval. <br /> <br />15. The setbacks for the homes shall be as generally shown on the Preliminary Landscape <br /> Plan, Sheet L-l, Exhibit "A", dated "Received January 6, 1995" on file with the Planning <br /> Department. In no case shall the rear yard setback be less than fifteen (15) feet and the <br /> side yard setbacks be less than five (5) feet. <br /> <br />16. On comer lots, the interior side yard setback shall be five (5) feet. <br /> <br />17. All additions to the primary structure in the future shall meet all development standards of <br /> the K-1-6,500 zoning district. <br /> <br />18. The developer shall prepare development standards for inclusion within the CC&K's and <br /> PUD Development Plan for decks, patio covers, pools, and other accessory structures for <br /> review and approval by the Planning Director prior to approval of a final map. Said <br /> standards shall limit such structures in such a way as to ensure adequate open space in <br /> rear/side yards while allowing reasonable use of accessory structures. <br /> <br /> 19. This PUD shall be subject to the permitted and conditional uses of the K-1-6,500 zoning <br /> district, except as modified herein. <br /> <br /> 20. The developer is required to design, construct, and obtain all approvals to install a 12 foot <br /> wide Emergency Vehicle Access connection over the railroad tracks to connect the ends <br /> of St. Iohn Street. The specific details shall be submitted in conjunction with the final map <br /> for review and approval of the Planning Director. The developer shall bond for this <br /> improvement and prior to occupancy of the first unit, the EVA shall be installed. The City <br /> shall assist the developer in obtaining the necessary approvals from the railroad to <br /> construct said EVA. <br /> <br /> 21. The applicant shall submit a final lighting plan for the building and the site for the review <br /> and approval of the Planning Director prior to issuance of building permits. In general, <br /> the applicant shall seek to use street lights and light standards which are complementary to <br /> the "Downtown" design theme. <br /> <br /> 22. All utilities required to serve any existing or proposed development on-site shall be <br /> installed underground, unless otherwise determined by the City Engineer. <br /> <br /> 23. The design details for the low-flow crossing, creek trail, and mini-park (which shall <br /> include play equipment for children) shall be submitted in conjunction with the tentative <br /> map for review and approval. <br /> <br /> PUD-94-04 - City Council Conditions Of Approval - Page 3 <br /> <br /> <br />
