EXHIBIT B <br /> <br /> Proposed Conditions of Approval <br /> Case PUD-91-19-1H <br /> July 5,' 1994 <br /> CITY COUNCIL <br /> <br /> 1. The proposed development shall conform substantially to the site <br /> plan, building elevations, and related materials, Exhibit A <br /> (dated "Received June 28, 1994"), on file with the Planning <br /> Department, except as modified by these conditions. <br /> <br /> 2. All conditions of Case PUD-91-19 shall remain in full force and <br /> effect. <br /> <br /> 3. The developer shall submit a revised landscape plan for the front <br /> and side yard areas which reflects the revised Fire Department <br /> turnaround location. This revised landscape plan shall be <br /> submitted for the review and approval of the Planning Director <br /> prior to the issuance of a building permit. This landscape plan <br /> shall be substantially similar in design intent with the <br /> landscape plan approved with PUD-91-19. The proposed trees on <br /> the northern side of the structure shall be a 36" box size. <br /> <br /> 4. The developer shall submit a plan illustrating the design of the <br /> deck to be used along the rear elevation of the structure to the <br /> Planning Director for review and approval prior to the issuance <br /> of a building permit. The deck shall be designed so as to <br /> minimize any exposed support structures for the deck through the <br /> use of lathe screening, stepping the deck, and/or using a <br /> cantilevered support system. No flat yard areas shall be graded <br /> at the rear of the structure for recreational purposes. <br /> <br />5. The developer shall provide an updated tree report for the review <br /> and approval by the Planning Director prior to the issuance of a <br /> building permit. This report shall evaluate the impact of the <br /> revised house location and shall identify appropriate <br /> mitigations, if any. If it is determined that this revised house <br /> location would be detrimental to the health of the adjacent <br /> existing trees, the Planning Director may determine that the <br /> design of the structure should be modified to eliminate any <br /> adverse effect on the health of the trees. <br /> <br />6. The developer must apply for and receive a building permit for <br /> this lot within three years of the date of this approval and must <br /> begin construction of the private roadway serving this lot and <br /> post the required bonds for its completion, to the satisfaction <br /> of the city, prior to September 1, 1995.
