5. The ceanothus along the frontage road shall be clustered in naturally appearing groups and <br /> additional native drought tolerant shrub types shall be added to the plant palette to promote <br /> visual interest and variety. This change shall be coordinated with the developer of the new <br /> home allowed by PUD-91-12. These details shall be submitted for review and approval in <br /> conjunction with any house plan application. <br /> <br />6. The developer shall establish a recorded maintenance agreement for the project. The <br /> agreement shall designate responsibilities for maintaining all common private utilities, <br /> private streets, and landscape area between the frontage road and Foothill Road. The City <br /> shall be granted the rights and remedies of the association, but not the obligation, to <br /> enforce the maintenance obligations. The City Attorney shall review and approve the <br /> proposed maintenance agreement prior to the recordation of a Parcel Map for the project. <br /> The developer shall coordinate this agreement with the developer of the property to the <br /> south to establish one (1) comprehensive maintenance agreement. <br /> <br />7. Property owners to the west who currently have access rights over the private road shall be <br /> granted access rights to new private roads and additional access rights should they wish to <br /> develop in the future. These access rights shall be granted at the time of parcel map <br /> recorda~on. The applicant shall be eligible for a pro-rata reimbursement of the access road <br /> construction costs by new development. Those new property owners shall be required to <br /> join into the maintenance agreement to pay their pro-rate share of road and landscape <br /> maintenance expenses. <br /> <br />8. Property owners to the south shall be granted access rights over the frontage road should <br /> they wish to eliminate their current access to Foothill Road and connect to the frontage <br /> road. This condition shall be reflected on the Parcel Map. <br /> <br />9. The applicant shall comply with the recommendations of the geotechnical report prepared <br /> for Lamb Land Surveying, dated November 20, 198, by Ternsearch, Inc. The applicant's <br /> geotechnical consultant shall review and approve all foundation, retaining wall, and <br /> drainage geotechnical aspects of the f'mal development plans to ensure that the <br /> recommendations have been properly incorporated into the development. The consultant <br /> shall certify by writing on the plans or as otherwise acceptable to the Director of Building <br /> Inspection that the final development plan is in conformance with the geotechnical report <br /> approved with the project. <br /> <br />10. The property is hereby rezoned to the PUD-LDR district. <br /> <br />11. Prior to parcel map approval, a bond for the private improvements including but not limited <br /> to streets, water, sewer, and storm drains shall be submitted to the satisfaction of the City <br /> Engineer. These improvements shall be constructed within one year of the recording of the <br /> parcel map unless otherwise approved by the Planning Director or City Engineer. <br /> <br />12. Any new home or remodeling of the existing home shall be subject to design review <br /> pursuant to the City of Pleasanton Municipal Code requirements. <br /> <br /> Page 3 <br /> <br /> <br />
