The City shall be granted the rights and remedies of the <br /> association, but not the obligation, to enforce the <br /> maintenance responsibilities of the property owners <br /> association. The CC&R's shall be subject to the review and <br /> approval of the City Attorney prior to recordation of any <br /> final map. <br /> <br /> 7. Areas "A", "B", and "C" shall be subject to the permitted <br /> and conditional uses of the R-1 One Family Residential <br /> District as listed under Sections 18.32.030 and 18.32.040 of <br /> the Pleasanton Municipal Code, except that multi-family <br /> dwellings are allowed only in Areas "A" and "B". <br /> <br /> 8. Construction Phasing <br /> <br />~ a. Any proposed phasing of this development shall be <br /> depicted on the tentative tract map and shall include <br /> narrative explaining the proposed phasing. The City <br /> Planning Director may approve modifications to said <br /> phasing plan so long as satisfactory access is present <br /> and other public safety measures are addressed. Unless <br /> otherwise approved by the Planning Director, the <br /> applicant shall complete all of the on-site <br /> improvements in a phase at one time (including all <br /> improvements around future building pads). All <br /> remaining pad areas shall be seeded and kept in a neat <br /> and weed-free manner at all times. <br /> <br /> b. With the first construction phase, the developer shall <br /> install the landscape/recreation area improvements in <br /> the ACTC, as shown on the development plan, to a point <br /> on the ACTC concurrent with the eastern leg of "JJ" <br /> loop in Area "C". With construction of any portion of <br /> the final 50% of the overall project (248 units) the <br /> developer shall install the remaining ACTC <br /> improvements, and shall remove the existing chain-link <br /> fence between the ACTC and Tassajara Creek. <br /> <br /> The applicant would be reimbursed by the developer(s) <br /> of Hacienda Business Park Lot 60 for their pro-rata <br /> share of the construction costs. If, however, these <br /> improvements are installed by a developer on HBP Lot <br /> 60, then the applicant shall reimburse the Lot 60 <br /> developer for this project's share of the costs. <br /> <br /> c. With completion of the ACTC landscape/recreation area <br /> improvements, the developer shall construct a paved <br /> pathway/driveway along the westerly top-of-bank of <br /> Tassajara Creek. The pathway/driveway design shall <br /> conform to City of Pleasanton and Zone 7 standards. <br /> All work to be done in Tassajara Creek requires an <br /> encroachment permit from Zone 7. <br /> <br /> -B-4- <br /> <br /> <br />
