Ordinance No. 1595 <br />Page Two <br /> <br /> (c) Any dog which engages in, or is found to <br /> have been trained to engage in exhibitions of <br /> dog fighting; or <br /> <br /> (d) Any dog at large found to attack, menace, <br /> display threatening or aggressive behavior or <br /> otherwise threaten or endanger the safety of <br /> any domestic animal or person. <br /> <br /> 2. "Dangerous dog" does not mean any dog in a <br /> situation in which it is shown that the person or <br /> domestic animal which had been attacked, threatened <br /> or menaced had: <br /> <br /> (a) Provoked, tormented, teased, or abused <br /> the dog into the behavior alleged; or <br /> <br /> (b) Committed a wilful trespass or other tort <br /> or crime upon the private property of the <br /> owner or person in control of the dog; or <br /> <br /> (c) Threatened or committed an unprovoked <br /> assault or battery against the owner or person <br /> in control of the dog. <br /> <br /> 3. A "dog is under the control of an individual" <br /> if the dog is within 50 feet of the individual at <br /> all times. <br /> <br /> 4. A "developed area" shall mean an irrigated <br /> lawn area, parking lot or roadway. <br /> <br /> 5. An "undeveloped area" shall mean all other <br /> areas of the Augustin Bernal Park." <br /> <br /> Section 2: Section 13.08,205 is hereby added to the Pleasanton <br /> Municipal Code to read as follows: <br /> <br /> "Section 13.08.205 ~nq Glidinq Prohibited. <br /> <br /> Hang gliding and hang gliders are prohibited in Augustin <br /> Bernal Park." <br /> <br /> Section 3: A s,,mmary of this ordinance shall be published once <br /> "' within fifteen (15) days after its adoption in "The Tri- <br /> Valley Herald," a newspaper of general circulation <br /> published in the City of Pleasanton, and the complete <br /> ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its <br /> adoption. <br /> <br /> <br />
