park or adversely affect the value of the park. Nothing in <br />this section is intended to abridge the right of the Park <br />Owner to manage his/her park in a reasonable manner. <br /> <br />Section 6.60.040 Petition Process Other Than Fair Return <br /> and Service Reduction Petitions. <br /> <br />A. Initiation of Petition. The PMHC may be requested to <br />meet on an issue or issues of interest to a Home Owner or a <br />Park Owner. The request must be on a petition and does not <br />require any particular number of signatures beyond that of the <br />petitioner. The petition must identify the problem(s) to be <br />addressed by the PMHC and may recommend any solution for <br />consideration of the PMHC members. <br /> <br />B. Prerequisite to Petition. Any such petition which <br />involves a grievance regarding a specific park may be <br />considered by the PMHC only after the following events have <br />occurred: <br /> <br /> 1. The petitioner must have submitted the issue in <br /> writing directly to the park manager. <br /> <br /> 2. The petitioner did not obtain a satisfactory <br /> resolution of the issue within thirty (30) days from the <br /> written submittal. <br /> <br />C. PMHC Action. The PMHC shall hold as many hearings on a <br />petition as it deems appropriate given the subject matter of <br />the petition. The PMHC shall render a written decision (with <br />respect to those areas where it has the authority to do so) or <br />a written recommendation within ten (10) days of its final <br />meeting on the matter unless this time period is extended by <br />agreement of the parties to the issue. In no case shall the <br />meetings be prolonged in order to frustrate the matter at <br />issue. <br /> <br />D. Appeal from PMHC Action. Any decision of the PMHC may be <br />appealed to the Pleasanton City Manager, provided said appeal <br />is filed within thirty (30) days of the decision by the PMHC. <br />The City Manager shall designate an impartial arbitrator who <br />shall have the same jurisdiction and authority as the PMHC <br />unless otherwise stipulated by the parties. The costs of <br />arbitration shall be split equally between the affected Park <br />Owner, the affected Tenant, and the City of Pleasanton. <br /> <br /> Section 6.60,050 Capital Improvement Costs. <br /> <br />A. Amortization of Capital Costs. A Park Owner may, at the <br />Park Owners' option, amortize Capital Improvement costs over <br />a multi-year period, up to ten years.
