utilizing the concept of net operating income and a 1992 base <br />year, intended to provide the necessary adjustment mechanisms <br />to meet constitutional requirements. <br />H. The Council finds that the adoption of the ordinance <br />codified in this chapter will not have a significant, <br />substantial or adverse effect on the physical environment of <br />the community because enactment of this chapter involves no <br />deviation from the General Plan and no change in the present <br />use of any property within the city. <br /> <br />Section 6.60.020 Definitions. <br /> <br />A. "Adjusted Monthly Rent" - The monthly Space Rent for each <br />mobile home space in Pleasanton as adjusted annually as <br />provided herein. <br /> <br /> B. "Capital Improvements" - Capital improvements are any <br /> additions or betterments made to a park such as, but not <br /> limited to, a new swimming pool, a new building, a new fence <br /> or a new road where one of the same size, function and quality <br /> had not existed before. For the purpose of this Ordinance, <br /> the substantial rehabilitation or replacement of any existing <br /> capital improvements in any park such as rebuilding the <br /> driveway or replacement of the sewer line shall be treated as <br /> a capital improvement. <br /> <br /> C. "City Manager" means the City Manager of the City of <br /> Pleasanton or the Manager's designate. <br /> <br /> D. "Cost of Living" ("COL") - The change in the Consumer <br /> Price Index for the San Francisco-Oakland-San Jose <br /> Metropolitan Area (All Items Index; All Urban Consumers) for <br /> the twelve (12) month period ending in August each year as <br /> published by the Bureau of Labor Statistics, U.S. Department <br /> of Labor. If this index shall delete the rental housing <br /> index, then a rental housing index shall be selected by the <br /> Pleasanton Mobile Home Committee for inclusion in computing <br /> the appropriate cost of living adjustments. <br /> <br /> E. "Government Regulated Expenses" - Expenses such as, but <br /> not limited to, property taxes, payroll taxes, water, garbage, <br /> sewer, licenses and fees and government mandated improvements. <br /> <br /> F. "Home Owner" or "Tenant" - Any person entitled to occupy <br /> a mobile home dwelling unit pursuant to ownership thereof or <br /> a rental or lease arrangement with the owner thereof. <br /> <br /> G. "Housing Services" - Those services provided and <br /> associated with the use or occupancy of a mobile home space, <br /> including but not limited to repairs, insurance, maintenance, <br /> replacement, painting, light, heat, water, laundry facilities <br /> <br /> - 3 - <br /> <br /> <br />
