Except for matters concerning fair return adjustments, base year <br /> rent adjustments and service reductions, Sections 6.60.070 to 6.60.120 of this <br /> Chapter, the PMC shall have the power to make decisions on any matter relative to <br /> this Ordinance which is not preempted by State law. <br /> <br /> (Subsection G, no change.) <br /> <br /> 6.60.040 Petition process other than fair return adiustment~ base year <br /> rent adiustmenh and service reduction petitions. <br /> <br /> A. Initiation of Petition. The PMC may meet on an issue or issues of interest to a <br /> home owner or park owner. The request must be on a petition but does not <br /> require any particular number of signatures beyond that of the Petitioner. The <br /> petition must identify the problem(s) to be addressed by the PMC and may <br /> recommend a solution. <br /> <br /> B. Prerequisite to Petition. The PMC may consider a petition that involves a <br /> specific Park but the petition may be considered by the PMC only after the <br /> following events have occurred: <br /> <br /> 1. The Petitioner has submitted the issue in writing to the Park Owner. <br /> <br /> 2. A satisfactory resolution of the issue has not been achieved within thirty <br /> (30) days from the written submittal. <br /> <br />· C. PMC Action. The PMC shall hold as many hearings on a petition as it deems <br /> appropriate given the subject matter of the petition. If requested by any party, the <br /> PMC shall render a written decision within 10 days of its decision. <br /> <br /> D. Appeal from PMC Action. Any decision of the PMC may be appealed to the <br /> Pleasanton City Manager, provided the appeal is filed within thirty (30) days of the <br /> decision. The City Manager shall designate an impartial arbitrator who shall have <br /> the same jurisdiction and authority as the PMC unless the panics stipulate <br /> otherwise. The costs of arbitration shall be split equally between the affected park <br /> owner, the affected home owner or Home Owner's Association, and the City of <br /> Pleasanton. <br /> <br /> 6.60.050 Capital Improvement Costs. <br /> <br /> A. Capital improvements; amortization. Ifa park owner constructs new capital <br /> improvements as provided in Section F below, the park owner shall amortize the <br /> costs as provided in this section. In addition, if a park owner rehabilitates or <br /> replaces any existing capital improvements, a park owner shall amortize as <br /> provided in this section only the difference between the original cost of the capital <br /> improvement and the cost to rehabilitate or replace the capital improvement. <br /> <br /> <br />
