Ordinance No. 1701 <br /> Page 15 <br /> matter, determines that the increased amenities/services is consistent with <br /> comparable parks in the East Bay. No park owner with less than 50 spaces shall <br /> increase these amenities or service levels such that the expenses relative thereto <br /> increase more than $250, or more than 5% over such expenses for the prior year <br /> (ending 9/30), whichever is less, unless (a) the increases in expenses above $250 <br /> (or the 5%) are not passed on to the home owners by a rent increase, (b) the home <br /> owners give their prior approval, or (c) the PMC, after review of the matter, <br /> determines that the increased amenities/services is consistent with comparable <br /> parks in the East Bay." <br /> <br /> Section 4: Section 1 (part) of Ordinance 1588 and Section 6.60.120 of the Pleasanton <br /> Municipal Code are hereby amended to read as follows: <br /> <br /> "6.60.120 Service reductions. <br /> <br /> A. No park owner shall reduce the service levels existing at the park as of the <br /> effective date of this Ordinance without meeting and conferring with the home <br /> owners prior to any such reduction. A majority of the home owners within a park <br /> may file a petition alleging that service reductions have occurred. A hearing <br /> officer shall conduct a hearing thereon following the procedures set forth in <br /> Section 6.60.080 of this Chapter. <br /> <br /> (Subsections B - D, no change.)" <br /> <br /> Section 5: Section 6.60.135 is hereby added to the Pleasanton Municipal Code to read as <br />. follows: <br /> <br /> "6.60.135 Home owners review of expenses. <br /> <br /> Ira home owner questions any of the calculations used for any rent increase, the <br /> home owner shall request within 30 days after receiving notice of the rent increase <br /> to meet with the park owner or the park owner's representative to answer the <br /> home owner's concern. If the matter cannot be resolved satisfactorily, the home <br /> owner may request the City Manager to review the matter. The City Manager may <br /> select whatever professional persons are deemed necessary to assist in the review. <br /> The park owner shall make the pertinent records available for review. If the matter <br /> cannot be resolved satisfactorily, the matter shall be referred to the PMC for <br /> resolution." <br /> <br /> <br />
