Ordinance No. 1701 <br />Page 14 <br /> <br /> rent increase needed to cover increases in operating expenses and real property <br /> taxes shall be calculated in the following manner which is structured to permit <br /> growth of the net operating income of the park and to provide a fair and <br /> reasonable return on investment based upon objective standards: <br /> <br /> (Subsections 1 and 2, no change.) <br /> <br /> (Section H, no change.)" <br /> <br />Section 2: Section 1 (part) of Ordinance 1588 and Section 6.60.080 of the Pleasanton <br /> Municipal Code are hereby amended to read as follows: <br /> <br /> "6.60.080 Fair return adiustment procedures. <br /> <br /> A. Fair return petitions. <br /> <br /> (Subsection 1, no change.) <br /> <br /> 2. A fair retum petition shall contain at least the following information: <br /> <br /> (Paragraphs a - d, no change.) <br /> <br /> e. The actual operating expenses and real property taxes by <br /> category for the mobilehome park for a two (2) year period ending <br /> no more than four (4) months before the proposed effective date of <br /> the increase; <br /> <br /> (Paragraphs f-j, no change.) <br /> <br /> (Subsections 3 - 4, no change.) <br /> <br /> (Sections, B - K, no change.)" <br /> <br /> Section 3: Section 6.60.115 is hereby added to the Pleasanton Municipal Code to read as <br /> follows: <br /> <br /> "6.60.115 Maintenance of amenities and service levels. <br /> <br /> As of the effective date of this Ordinance, each park owner provides certain <br /> amenities and service levels to the home owners. No park owner with 50 or more <br /> spaces shall increase these amenities or service levels such that the expenses <br /> relative thereto increase more than $500, or more than 5% over such expenses for <br /> the prior year (ending 9/30), whichever is less, unless (a) the increases in expenses <br /> above $500 (or the 5%) are not passed on to the home owners by a rent increase, <br /> (b) the home owners give their prior approval, or (c) the PMC, after review of the <br /> <br /> <br />
