D. No reduction in future annual new residential unit limits shall affect any major <br /> project or affordable housing project which has received growth management <br /> approval granting future years' allocations so long as the conditions in effect at the <br /> time of the initial approval remain unchanged and the approved project continues <br /> to meet all project requirements. Nothing herein, however, limits the City's ability <br /> to impose a development moratorium under State law. <br /> <br />17.36.070 Apportionment of Yeafly Total New Residential Units to Categories of <br /> Projects <br /> <br /> All new residential units shall be classified in one of the following categories and shall be <br />issued building permits in accordance with the regulations and limitations established for each <br />category. <br /> <br /> A. Categories of Projects. There shall be three categories of projects as defined <br /> below. <br /> <br /> 1. Affordable Housing Project. A project which meets the minimum <br /> requirements as established from time to time by the City for providing <br /> housing to either: <br /> <br /> a. lower-income households; or <br /> <br /> b. moderate-income households. <br /> <br /> The requirements for qualifying as an affordable housing project shall be <br /> established by the City in implementing its affordable housing program. <br /> <br /> 2. Major Project. A project which meets any of the following criteria: <br /> <br /> a. has 100 or more units; <br /> <br /> b. has fewer than 100 units but whose developer wishes the certainty <br /> of a multi-year allocation of at least three years; <br /> <br /> c. has received an annual allocation pursuant to a growth management <br /> program at a time prior to the effective date of this Ordinance <br /> which grants growth management approval to units in calendar <br /> year 1998 or later years. <br /> <br /> 3. First-come, First-Served Project. All projects and/or single unit <br /> applications which are neither an affordable housing project nor a major <br /> project as defined above. <br /> <br /> 6 <br /> <br /> <br />
