(ii) From April 1 through November 30, small project <br /> applicants shall use, first, the regular first-come, first-served <br /> sub-allocation, if available, and, then, if not available, shall <br /> use any available small project set-aside units. <br /> <br /> (iii) After December 1, small project applicants shall use the <br /> regular first-come, first-served sub-allocation. <br /> <br />d. Pro Ration of Project Permits, Generally <br /> The first-come, first-served sub-allocation is intended to be made <br /> available to developers in chronological order as building permits <br /> are ready to be issued. However, in certain instances when the <br /> demand for permits is known to exceed the number of permits <br /> available, the City shall pro rate the available permits. Should the <br /> pro ration yield units in excess of those available due to rounding, <br /> the City shall reduce the total to equal the units available in any <br /> manner it finds equitable. <br /> <br /> (i) Prior to the Beginning of Any Calendar Year <br /> If, prior to January 1 of any year, the City has processed <br /> building permit applications seeking the next year's <br /> first-come, first-served sub-allocation which, in the <br /> aggregate, exceed the annual sub-allocation less the small <br /> project set-aside, the City shall pro rate the permits to <br /> developers seeking permits. <br /> <br /> (a) First Priority. Permits shall be issued first to <br /> first-come, first-served projects which were under <br /> construction in the prior year and secured permits <br /> for, or attempted to secure permits for, all units it <br /> was qualified to be issued permits for during that <br /> year. <br /> <br /> (b) Second Priority. Permits shall be issued second to <br /> all projects eligible to apply for the available permits. <br /> Each project's pro rata share of the available <br /> sub-allocation shall be the percentage derived by the <br /> permits sought by the project (subject to the project <br /> limitations established herein) divided by all permits <br /> sought (subject to the same size limitations). <br /> <br /> (ii) Pro Ration of Project Permits, Prior to Availability of <br /> Unused Major Project Units, Small Project Set-Aside Units, <br /> or Units Remaining Available on December 1 <br /> <br /> 13 <br /> <br /> <br />
