(PMSA) based on family size as established by the Deparlxnent of Housing and Urban <br /> Development (HUD). The monthly rent for each of the affordable units shall not exceed <br /> one-twelfth of 30% multiplied by 80% of the median income level for the Oakland <br /> PMSA as reasonably determined by the Housing Coordinator on an annual basis for a <br /> household of one or two persons (as applicable for each unit). These restrictions shall run <br /> with the land and shall be formalized through a deed restriction recorded against the <br /> property. The details of such restrictions shall be subject to review and approval by the <br /> City Attomey and Housing Coordinator prior to the issuance of building permits for the <br /> project and shall be in place prior to occupancy of any of the units. <br /> <br />12. No building permits may be issued until the final parcel map is recorded which <br /> subdivides this 26.4 acre parcel (Assessor's Parcel Number 941-2779-4-1) from the <br /> proposed 3.0 acre park site. <br /> <br />13. The applicant shall comply with the recommendations of the noise study prepared by <br /> Wilson, Ihrig & Associates, Inc. dated July 21, 1997. <br /> <br />14. No major appliance repairs, servicing of vehicles, or other noise generating activities <br /> shall be conducted inside or nearby the maintenance building. The maintenance building <br /> garage doors shall remain closed when not being used for ingress/egress purposes. <br /> <br />15. No speed bumps or fencing shall be placed within the drive aisles of the project site <br /> unless otherwise approved by the City. <br /> <br />16. The applicants shall increase the sidewalk separation along the Owens Drive frontage to a <br /> 6 ft. minimum separation, increasing up to 10 ft. where feasible. Additionally, the <br /> applicants shall increase the width of the existing Owens Drive sidewalk at the comer of <br /> Hacienda and Owens Drive to 10 ft. Said modifications shall be shown on the plans <br /> submitted for issuance of building permits and shall be subject to the review and approval <br /> by the Planning Director and City Engineer prior to issuance of building permits for the <br /> project. <br /> <br /> 17. The applicants shall install a bridge across Tassajara Creek to connect the 6.6 acre park to <br /> the linear park at no cost to the City. The applicants shall be responsible for all costs <br /> associated with the construction of the bridge. The costs of the bridge construction shall <br /> not be credited against the park fees. The design of the bridge shall be approved by the <br /> Director of Parks and Community Services. The plans and specifications of the bridge <br /> shall be approved by the Director of Public Works. The applicants shall obtain all <br /> permits and approvals, including those from Zone 7, in order to construct the bridge. The <br /> bridge shall be constructed and completed no later than completion of the construction of <br /> the 6.6 acre neighborhood park. <br /> <br /> 18. The applicants shall install a pathway connection from the eastem end of the existing <br /> linear park pathway to the westem side of the Tassajara Creek. The pathway connection <br /> shall match the design of the existing pathway and shall be designed to connect with the <br /> <br /> PUD-8 i -30-71D <br /> Conditions of Approval <br /> <br /> <br />
